Accord- <br />ing to the then Property Services Manager,.Councilman Clifford <br />contacted him and requested a copy of the lease attached to <br />the report. The Property Services Manager then delivered a <br />copy of the January 15 draft lease to the City Clerk's Office <br />to be attached to the report. <br />It was never staffs intent to have the draft lease attached to <br />the Council report have be considered as a final document. I <br />am positive staff never would have characterized it as such <br />since by the 21st we already had a second draft of the lease <br />prepared. Unfortunately, at that time the City Clerk did not <br />tape record the Council meetings; therefore, there is no <br />specific record of the discussion on this matter. <br />For your information, the first draft of the lease was <br />prepared on January 15, the second on January 17, the third on <br />January 29 and the final lease was drawn up and signed on <br />January 31, 1992. <br />Staff's interpretation of the Council's action on January 21 <br />was that we were to negotiate an agreement with Golden State <br />Golf Centers which would produce a lease that would bring <br />about the actions outlined in their proposal to the City. <br />Obviously, this is not the understanding of at least some of <br />the Council members and I apologize for the misunderstanding. <br />Again, I stand behind the statement that the staff in no way <br />represented that the draft lease attached to the January 21, <br />1992 City Council report was the final lease. As pointed out <br />earlier, we already had revised this draft by the time the <br />Council meeting occurred and I find it difficult to believe <br />that we would not have stated that at the meeting, although I <br />have no record of such. Neither the Property Services Manager <br />or I would have anything to gain by not relating the latest <br />information to the City Council about our attempt to produce <br />a final lease. <br />In summary, if any Council member felt that the lease attached <br />to the report was the final lease, we were in error to not <br />bring the final lease document back to the Council for <br />approval.
