CITY Ca►F RIVER sa77E <br />INTER OF'F'ICE MEMO <br />TO: Honorable Mayor & City Council <br />FROM: Larry Paulsen <br />Assistant City Manager <br />DATE: July 23, 1993 <br />SUBJECT: FAIRMOUNT PARK GOLF COURSE LEASE <br />At Wednesday's Recreation and Cultural Committee meeting a <br />question was raised about the lease which is currently in <br />effect with the current lessee of the Fairmount Park Golf <br />Course. The question arose because at least one Councilmember <br />thought a lease attached to a City Council report dated <br />January 21, 1992 was the final lease. This is not the case, <br />since the final lease was not prepared and signed until <br />January 31, 1992. <br />The question that arises from this issue is, how could a lease <br />change after a document was shown to the City Council? In <br />1992, and for many years prior to that, it was common practice <br />that leases and contracts were not necessarily prepared and <br />finalized prior to Council action. In short, the City Council <br />authorized staff to finalize these documents with, in some <br />cases, broad authorization. IT SHOULD BE NOTED THIS PRACTICE <br />HAS CEASED AS A RESULT OF A DIRECTIVE FROM THE CITY MANAGER <br />AND CITY ATTORNEY ON JUNE 24, 1993. A copy of this directive <br />is attached. <br />AS TO THE SPECIFIC LEASE IN QUESTION, AN INVESTIGATION REVEALS <br />THE FOLLOWING: <br />City staff had put out a Request For Proposals for the <br />operation of the Fairmount Park Golf Course during the later <br />part of 1991. A Committee was created to review these <br />proposals and make a recommendation as to who should be <br />selected. To all parties involved, time was of the essence in <br />that the then current operator of the course was not maintain- <br />ing it in satisfactory fashion and it was important to get a <br />new operator on the premises as soon as possible. <br />In December, 1991 the Committee selected Golden State Golf <br />Centers as the successful proposer. On January 13, 1992 the <br />Committee's recommendation was taken to the Park & Recreation <br />Commission for its approval. As a result of the Committee's <br />and Commission's recommendation, a report was prepared for the <br />City Council agenda of January 21, 1992. I personally <br />prepared the report. It was written in such a way as not to <br />reference any specific lease document since we had no final <br />lease. When I prepare a report with a specific attachment for <br />approval, I always reference such a document in my report. In <br />1 <br />
