Council Memorandum · Page 2

2002 to October 30, 2003 and provide an option for a one year extension upon mutual consent of the
parties. This extension will allow the station operator to design the facility and obtain the County's
approval and for the City and the Operator to reach a longer term, more cost-effective agreement.

FISCAL IMPACT:

None, the current $24 per ton cost for greenwaste disposal will not change under the contract
amendment.

ALTERNATIVES:

The only alternative is to dispose of the greenwaste at the landfill at a cost of $33.01 per ton. This
alternative would also result in the City not obtaining our State mandated refuse diversion requirements.

RECOMMENDATIONS:

That the City Council:

1. Adopt the necessary resolution authorizing the granting of a First Amendment to Greenwaste Tipping
Agreement with Burrtec Waste Industries;

2. Authorize the City Manager or his designee to execute the First Amendment to Greenwaste Tipping
Agreement with Transfer Station operator Burrtec Waste Industries extending the current contract term to
October 30, 2003.

Prepared by:

Thomas J.
