OF MATHEWS - APPEAL - <br /> CONTINUED <br /> 3:00 P.M.--Further hearing was called on the appeal of Vanguard Builders, Inc., from <br /> the decision of the Growth Management Administrator in denying a Residential Develop- <br /> ment Permit for =he proposed division of approximately 4.6 acres of land into 22 lots <br /> situated on the northeasterly side of Thornton Street southeasterly of Mathews Street, Motion <br /> Case PS-120-789. 1hasmuch as the City Council Economic Development Committee is Second }X~ <br /> considering this case, :he hearing was further continued to 3une 23, 1981, at 3 p.m. All Ayes <br /> <br /> ZONING CASE R-38-801 - 11355 MAGNOLIA AVENUE - REZONING - ORDINANCE INTRODUCED <br />~3:00 P.M.--Hearing was called on the proposal of Tony Padilla, etal., Zoning Case <br />~R-38-801, to place the approximately .88 acre of vacant land situated on the northwest- <br />erly side of Magnolia Avenue southwesterly of Golden Avenue, being at 11355 Magnolia <br />;Avenue, in Zone R-3 and remove the same from Zone R-1-65; with the City Council to <br />also consider supplementing the requested zonin~ with Zone S. As heretofore directed <br />~by the City Council, the minutes of the City Planning Commission pertaining to this <br />~case are on file and are a part of the evidence submitted at this hearing, whether or <br />;not any portion thereof is read or discussed. The communication from the City Plan- <br />~ g Commission stated that the Commission, by a vote of 9 ayes =o 0 noes, approved <br />~Zone R-3 subject ~o the following conditions: (1) There shall be a two-year time <br />sllm~t in which to satisfy the following conditions and finalize this action. If the <br />;zoning is not adopted within two years of the date of introduction of the ordinance, <br />;the action taken on this petition shall be void. A time extension of not more than <br />,one year may be requested of the City Council by letter. Such time extension request <br />smust be received by the City Clerk thirty days prior to the end of the two-year limit; <br />(2) The provisions of public utility easements, water, street lights and electrical <br />iunderground and/or overhead facilities and fees in accordance with the rules and <br />,regulations of the Public Utilities Department; (3) Deed for widening b~gnolia Avenue <br />ate 77 feet from centerline; (4) Installation of curb and gutter at 59 feet from center- <br />sline, sidewalk and matching pavement on Magnolia Avenue; (5) Waiver of access to <br />Magnolia Avenue for Parcels 3 and 4; (6) Storm drain construction will be contingent <br />on engineer's drainage study; (7) Off-site improvement plans no be approved by the <br />Public Works Department and a surety posted to guarantee the required off-site improve- <br />ments prior to the final adoption of this zoning case; (8) Installation of sewers =o <br />serve this project; (9) Removal and/or relocation of irrigation facilities; (10) Re- <br />moval and/or relocation of trees as required; (11) A sewer extension may be required <br />to serve this propertT; (12) This property will not be allowed an opening in the <br />existing median on Magnolia Avenue; (13) Only one driveway approach will be allowed <br />'for =his property--to be curb-return type with 35-foot curb return radius, minimum 30 <br />feet wide, all to Public Works Departmen~ specifications; and (14) A recorded covenant <br />~and artcement will be required for the joint driveway and mutual access; determined <br />~that the proposed rezoning would not have a significant adverse environmental effect; <br />sand adopted the staff report and the environmental assessment as findings.
