OF PINE - ORDINANCE <br /> INTRODUCED <br /> 3:00 P.M.--Rearing was called on Resolution No. 14301, adopted January 27, 1981, for <br /> the proposed vacation of a portion of an alley located behind 4364 and 4350 First, <br /> Street and foz~ing an extension of an improved alley extending southeasterly from Pine <br /> Street, Case VAC-10-g01. As heretofore directed by the City Council, the minutes of <br /> the City Planning C~ission and the Environmental Protection Commission pertaining to <br /> this matter are on file and are a part of the evidence submitted at this hearing, <br /> whether or not any poT=ion =hereof is read or discussed. The communication from the <br /> City Planning Commission stated ~hat the Commission, by a vote of 8 ayes to 0 noes and <br /> 1 abstention, approved the proposed vacation subject to the following conditions: <br /> (1) This vacation shall be by ordinance or as otherwise approved by the Legal Depart- <br /> me=t; (2) Prior no adoption of the vacation, the applicant shall supply the City with <br /> documents acceptable to the City's Legal Department, signed by all affected property <br /> owners, holding the City harmless from any loss or impairment of access caused by the <br /> zvacation; (3) All utilities shall be satisfactorily relocated, protected, and/or <br /> replaced to the specifications of the affected departments and agencies, and easements <br /> ~for such facilities retained as necessary; and (4) An agreement guaranteeing the <br /> ~physical closure of the right-of-way together with a plot plan indicating the disposi- <br /> tion of the alley and the apportionment of the right-of-way shall be signed and sub- <br /> ~mitted by all adjacent o~ners for Public Works Department approval prior to final <br /> adoption of the ordinance vacating the alley. Quitclaim evidencing the disposi=ion of <br /> the right-of-way, if other than by operation of law, shall be executed prior to adop- <br /> tion of the vacation. The co~unication from the Environmental Protection Commission <br /> advised ~ha~ the Coy-mission, by a vote of 6 ayes to 0 noes, determined that the vaca- <br /> tion would not have a significant adverse effect on the environment. The Planning <br /> Director presented deparmental recce~nendations, together with maps of the area. No <br /> iprotests, either written or oral, were presented. No one was present wishing to speak <br /> ,on =he martar. The hearing was officially closed. The vacation was approved subject <br /> to the reco~,ended conditioms; it was determined =hat the proposed vacation would not <br /> ! <br /> shave a significant adverse evironmental effect; the staff re~ort and the environmental <br /> assessment were adopted as findings; and an ordinance entitled, "An Ordinance of the <br /> City Council of :he CiTy of Riverside, California, Making Its Findings and Determina- <br /> tions in the Matter of Resolution of Intentiom No. 14301, and Making Its Order Vacat- Motion X <br /> ing a Portion of an Alley Located Behind 4364 and 4350 First Street and Easterly of Second ~X~ <br /> Pine Street," was presented and introduced.
