<br />ZONING CASE C-17-812 - 4602 PINE STREET
<br />3:00 P.M.--Hearing was called on the request of James L. Bentley, etal., Zoning Case
<br />C-17-812, for a conditional use permit to establish, operate and maintain a fast food
<br />restaurant in an existing former service station structure on approximately
<br />one-fourth acre of land located at 4602 Pine Street, situated on the southerly corner
<br />of Pine Street and Tequesquite Avenue, in Zone C-2. As heretofore directed by the
<br />City Council, the minutes of the City Planning Commission pertaining to this case are
<br />on file and are a part of the evidence submitted at this hearing, whether or not any
<br />portion thereof is read or discussed. The communication from the City Planning Commis- ,
<br />sion stated that the Commission, by a vote of 4 ayes to 2 noes, approved the condi-
<br />tional use permit, subject to the conditions listed in full in the Commission minutes
<br />relative to this hearing; determined that the conditional use permit will not have a
<br />significant adverse environmental effect; and adopted the staff report and the environ-
<br />mental assessment as findings. The Plannin8 Director presented departmental recom-
<br />mendations, together with maps of the area. Mr. Bentley, representing the applicants,
<br />spoke in favor of the conditional use permit. Oral protests were presented and consid-
<br />'ered. Following discussion, the hearing was officially closed. The City Council
<br />upheld the action of the City Planning Commission in approving the conditional use
<br />~permit, subject to the recommended conditions, including the requirement for review
<br />of the conditional use permit at a public hearing before the City Planning Co--,ission
<br />one year following the opening date; determined that the granting of the conditional Motion
<br />use permit will not have a significant adverse environmental effect; and adopted the Second ~X[

<br />ZONING CASE C-15-812 - 2720 FOURTEENTH STREET - APPEAL - CONTINUED
<br />3:00 P.M.--Hearing was called on the appeal of Alan Ayazi relative to the conditions
<br />of the City Planning Co~ission in approving the request of Robert G. Rioa, etal.,
<br />for a conditional use permit to legalize, operate and maintain a service station and
<br />mini-market in an existing structure situated on the southerly side of Fourteenth
<br />Street between Victoria Avenue and Forest Street, located at 2720 Fourteenth Street, Motion
<br />in Zone C-3, Zoning Case C-15-81Z. In consideration of the appellant's request, the Second
<br />]hearing was continued to June 22, 1982, at 3 p.m. All Ayes

<br />[3:00 P.M.--Hearing was called on the appeal of Jess Long from the decision of the City
<br />~Planning Commission in approving the proposal of N. Jennings to create a one-lot tract
<br />,map for condominium purposes on approximately 1.5 acres of land to implement conversion
<br />;of 41 apartment units (known as Espana Apartments) to condomininms located at 965,
<br />1005 and 1015 Via Zapata, situated on the northeasterly side of Via Zapata southerly
<br />;of Central Avenue, in Zone R-3, Tract Map 18451. As heretofore directed by the City
<br />Council, the minutes of the City Planning Commission pertaining to this case are on
<br />,file and are a part of the evidence submitted at this hearing, whether or not any
<br />.'>ortion thereof is read or discussed. The communication from the City Planning Commis-
<br />'sion stated that the Commission, by a vote of 7 ayes to 1 no, approved the tract map,
<br />subject to the conditions listed in full in the Commission minutes pertaining to this
<br />,matter. The Planning Director presented departmental reco~endations, together with a
<br />.map of the area. Mr. Long spoke in support of the appeal and in opposition to the
<br />proposed conversion. Written protests previously submitted were considered.
<br />Mr. Randolph Erwin, representing the applicant, spoke in support of approval of the
<br />map. Following discussion, the hearing was officially closed. The City Council
<br />denied the appeal; and upheld the action of the City Planning Commission in approving
<br />Tract Map 18451, subject to all recon~ended conditions and the additional condition
<br />that no tenant shall be forced to move within one year of the date of recordation of
<br /> ,,
<br />the final map, and that any specific tenant will be given a six-month notice to vacate Motion ,X,
<br />his particular unit and will be entitled to receive a relocation allowance during that Second
