ANFORD - APPROVED - RESOLUTIONS <br /> [3:00 P.M.--Hearing was called on Resolution No. 14627, adopted February 23, 1982, for <br /> [the proposed vacation of a portion of Seventh Street right-of-way and contiguous alley <br /> ~approximately 500 feet easterly of Chicago Avenue, Case VAC-2-812. As heretofore <br /> :directed by the City Council, the minutes of the City Planning Commission and the <br /> [Environmental Protection Co~unission pertaining to this matter are on file and are a <br /> [part of the evidence submitted at this hearing, whether or not any portion thereof is <br /> }read or discussed. The c~unication from the City Planning Co~ssion stated that <br /> ~the Comm4ssion, by a vote of 6 ayes to 0 noes, approved the proposed vacation, subject <br /> :to the following conditions: (1) This vacation shall be by ordinance or as otherwise <br /> ~approved by the Legal Department; (2) Prior to adoption of the vacation, the applicant <br /> ~shall supply the City with documents acceptable to the City's Legal Department, signed <br /> 'b all affected property owners, holding the City harmless from any loss or impairment <br /> , y <br /> ~of access caused by the vScation; (3) All utilities shall be satisfactorily relocated, <br /> ~protected and/or replaced to the specifications of the affected departments and agen- <br /> =cies and easements for such facilities retained as necessary; (4) The vacated right- <br /> iof-way shall be quitclaimed to the adjacent owners of record and incorporated into the <br /> adjacent parcel; (5) Both Seventh Street and the adjacent alley shall be vacated at <br /> the same time; (6) The termination of Seventh Street and the alley shall be to Public <br /> ~Works Department specifications; (7) This street vacation shall be finalized concur- <br /> rently with the recordation of Parcel Map 18249; and (8) This street vacation shall be <br /> contingent upon a parcel map waiver to Join Parcels 2 and 3 of Parcel Map 13803, which <br /> may be administratively approved with no further Planning Commission action, unless <br /> access to Parcel 3 can be provided which meets the requirement of the zoning ordi- <br /> nance. The communication from the Environmental Protection Commission advised that <br /> the Commission, by a vote of 10 ayes to 0 noes, determined that the proposed vacation <br /> would not have a significant adverse environmental effect. A written report was <br /> submitted from the City Manager and the Planning Director recommendinE that the City <br /> Council vacate the entire subject alley but retain the portion adjacent to the existing <br /> apartment building if the owner will not accept the alley vacation and its incorpora- <br /> tion into his property. No one was present wishing to speak on the matter. No <br /> ~protests, written or oral, were presented. Following a brief discussion, the hearing <br /> ~was officially closed. The vacation was approved subject to the recommended condi- <br /> ~tions; it was determined that the proposed vacation would not have a significant <br /> ~adverse environmental effect; and the staff report and the environmental assessment <br /> ~were adopted as findings; and Resolution No. 14641 of the City Council of the City of <br /> ~Riverside, California, Making Its Findings and Determinations in the Matter of Resolu- <br /> ~tion of Intention No. 14627; Reserving Permanent Easements and Rights of Way for <br /> =Sewer, Storm Drain and Water Line Facilities as Provided in Section 8340 of the Streets, <br /> |and Highways Code, and Determining That the Public Convenience and Necessity Require <br /> ~the Reservation of Such Easements as Provided in Section 8341 of Said Code; and Making <br /> ~Its Order Vacating That Portion of Seventh Street Right-of-Way and Contiguous Alley <br /> ~Located Easterly of Chicago Avenue, and Identified in Exhibit A of Resolution No. 14627 <br />- ~as Parcel 1; and Resolution No. 14642 of the City Council of the City of Riverside, <br /> .California, Making Its Findings and Determinations in the Matter of Resolution of <br /> ~Intention No. 14627; Reserving Permanent Easements and Rights of Way for Sewer, Storm <br /> <br />Motion <br />Second <br />All Ayes <br /> <br />A,X,X,X,X,X X, <br /> <br />.: <br /> <br /> ix: :x: <br /> <br />67-366 <br /> <br /> <br />
