<br /> ~General Plan by deleting the existing City-wide Park (proposed Mockingbird Park) land
<br /> ~use designation on the approximately 23.85 acres of land located on the southeasterly
<br /> [side of Dufferin Avenue approximately 640 feet easterly of Van Buren Boulevard, being
<br /> ~in the 9300 block of Dufferin Avenue, and placing this property in a land use designa-
<br /> ~tion deemed more appropriate by the City Council. The hearing had been continued from
<br /> ~time to time, pending review and recommendation from the Environmental Protection ,
<br /> ~Commission. A written report was submitted from the City Manager and the Planning .
<br /> ~Director advising that the property owner has asked for, and the Environmental Protec-
<br /> triot Commission has agreed to, a continuance of its hearing on the matter to Septem-
<br /> ~ber 12, 1984; and recommending that the City Council further continue its hearing
<br /> ipending completed review and recommendation from the Environmental Protection Motion ,X,
<br /> ,Commission. Accordingly, the City Council continued the hearing to October 16, 1984, Second ,X,

<br /> ~AMENDMENT TO THE LAND USE ELEMENT OF THE GENERAL PLAN (CASE GP-15-834) AND ZONING CASE
<br /> ~R-38-834 - CENTRAL BETWEEN RIVERSIDE FREEWAY AN~ AT&SF RAILROAD - ORDINANCE INTRODUCED
<br /> ~3:00 P.M.--Hearing was called on the proposal of James R. Hildebrandt to (1) amend the
<br /> ,Land Use Element of the City of P, iverside General Plan by deleting the existing Public
<br /> and Institutional and Medium Low Density Residential land use designations on the
<br /> approximately 6.72 acres of vacant land situated on the north side of Central Avenue
<br /> between the Riverside Freeway and the Atchison, Topeka and Santa Fe Railroad right-of-
<br /> way and placing this property in the Retail Business and Office land use designation
<br /> or other land use designations deemed more appropriate by the City Council, Case
<br /> GP-15-834; and (2) place the above-described property in Zone C-3 and remove the same
<br /> from Zone R-1-65; with the City Council to also consider supplementing the requested
<br /> zoning with Zones S and X, Zoning Case R-38-834. As heretofore directed by the City
<br /> Council, the minutes of the City Planning Commission and the Environmental Protection
<br /> Commission pertaining to these cases are on file and are a part of the evidence submit-
<br /> ted at this hearing, whether or not any portion thereof is read or discussed. The
<br /> communication from the City Planning Commission stated that the Commission, by a vote
<br /> ;of 7 ayes to 0 noes, approved the Retail Business and Office land use designation and
<br /> ]Zone C-3, the rezoning being subject to the following conditions: (1) There shall be
<br /> ~a two-year time limit in which to satisfy the following conditions and finalize this
<br /> ~action. If the zoning case filed for this property is not adopted within two years of
<br /> ~the date of introduction of the ordinance, the action taken on this petition shall be
<br /> ~void. A time extension of not more than one year may be requested of the City Council
<br /> by letter. Such time extension request must be received by the City Clerk 30 days
<br /> ~rior to the end of the two-year limit; (2) Approval of Zone C-3 is contingent upon
<br /> ,zmplementation of Zon~,g Case C-32-834 or its equivalent. Prior to finalization of
<br /> ,this case, the applicant shall submit a covenant running with the land that only a
<br /> emini-warehouse use shall be placed on this property; (3) The provision of public
<br /> ,utility easements, water, street lights and electrical underground and/or overhead
<br /> facilities and fees in accordance with the rules and regulations of the Public Utili-
<br /> ties Department; (4) The Legal Department shall be requested to prepare the necessary
<br /> resolution amending the General Plan for adoption within 30 days of approval of this
<br /> case; (5) Installation of a Class 2 bikeway on Central Avenue to Public Works Depart-
<br /> ment specifications; and (6) A covenant and agreement subject to the City Attorney's
<br /> approval shall be recorded by the developer to ensure that any future buyers or users
<br /> of the property are informed that the property will not be served by an opening in the
<br /> ~future median. The communication from the Environmental Protection Commission advised
<br /> ~that the Commission, by a vote of 7 ayes to 0 noes, determined that approval of the
<br /> ~Retail Business and Office land use designation and Zone C-3 would not have a signifi-
<br /> ~cant adverse environmental effect. The Planning Director presented departmental
<br /> :recommendations, together with maps of the area. Mr. Hildebrandt spoke in support of
<br /> ~the General Plan amendment and the rezoning, and requested that the second sentence of
<br /> ~Condition (2) of the rezoning be amended to read, "Prior to finalization of this case,
<br /> ~the applicant shall submit a covenant running with the land stating that uses other
<br /> ~than mini-warehouses will not be permitted without first obtaining City Council ap-
<br /> ~proval." One written protest was presented and considered. No oral protests were pre-
<br /> ~sented. Following discussion, the hearing was officially closed. It was determined
<br /> ~that the General Plan amendment and the rezoning would not have a significant adverse
<br /> ~environmeDtal effect; and zhe staff report and the environmental assessment were
<br /> ladopted as findings. The proposed General Plan amendment was approved as recommended
<br /> by the City Planning Commission; and the City Attorney was requested to prepare the
