LAW~CE ST~ET - APPROVED - RESOLUTION <br />~3:00 P.M.--Hearing was called on Resolution No. 15318, adopted March 27, 1984, for the <br />:proposed vacation of an approximately 80-foot-wide by 800-foot-long portion of St. <br />:Lawrence Street generally located between Lincoln Avenue and the Atchison, Topeka and <br />:Santa Fe Railroad right of way, Case VAC-5-834. As heretofore directed by the City <br />:Council, the minutes of the City Planning Cow-sis.ion and the Environmental Protection <br />:Commission pertaining to this matter are on file and are a part of the evidence submit- <br />'ted at th~s hearing, whether or not any portion thereof is read or d~scussed. The <br />:communication from the City Planning Coma~ssion stated that the Coa~ssion, by a vote <br />'of 8 ayes to 0 noes, approved the vacation subject to the following conditions: <br />:(1) This vacation shall be by resolution or as otherwise approved by the Legal Depart- <br />:merit; (2) The Legal Department shall determine which, if a~y, nearby property owners <br />:will be s~gnificantly affected by the vacation action, and the applicant shall provide <br />'the <br />, appropriate Hold Harmless documents to the specifications of the Public Works <br />:Department; (3) All utilities shall be satisfactorily telorated, protected and/or re- <br />:placed to the specifications of the affected departments and agencies, and easements <br />,for such facilities retained as necessary; (4) St. Lawrence Street 8hall be tera~Lnated <br />,as a public cul-de-sac ~o Public Works Department specifications. Improvement of the <br />:cul-d - ac to Lincoln Avenue shall be required to Public Works Department specifica- <br /> ss <br />etlons; and (5) Access by the Fire Department to its training facility shall be main- <br />:rained at all t~mes, preferably by a mechanically-operated gate or key card system, to <br />:the specifications of the Fire Department. The communication from the Environmental <br />:Protection Commission advised that the Co~gnission, by a vote of 6 ayes to 0 noes, <br />edeterm~ned that the vacation would not have a significant adverse environmental effect. <br />,The Planning Director presented departmental recown~endations, together with maps of <br />,the area. A corm~unicat~on was presented from the P~Lverside County Flood Control and <br />:Water Conservation District advising that the vacation will affect the District's Monroe <br />:Street Storm Channel, an underground concrete box structure crossing under St. Lawrence <br />:Street ten feet south of the Atchison, Topeka and Santa Fe Railroad property line; and <br />:stating their requirement for the reservation of an easement, 20 feet in width, to con- <br />:nect their existing easement on either side of the street, as well as a gate in any <br />:fence on the west property line of Parcel 4 to allow access along the right-of-way <br />:easement. No one was present wishing to speak on the matter. No written protests <br />~ere presented. The hearing was officially closed. The vacation was approved subject <br />'to the reconn~ended conditions and the additional requirements of the Flood Control Dis- <br />:trict as stated above; it was determined that the proposed vacation would not have a ., <br />:significant adverse environmental effect; and the staff report and the environmental <br />:assessment were adopted as findings. Resolution No. 15341 of the City Council of the <br />'Cit <br />, y of Riverside, California, Making Its Findings and Determ~nations in the Matter of <br />:Resolution of Intention No. 15318; Reserving an Easement for Storm Drain Purposes and <br />:Determining That the Public Convenience and Necessity Require the Reservation of Such <br />: ement; <br />Eas and Making Its Order Vacating a Portion of St. Lawrence Street Located <br />~Generally Between Lincoln Avenue and the Atchison, Topeka and Santa Fe Railroad, was <br />[p sented; and the title having been read, and further reading waived by the unanimous <br /> re <br />~consent of Councilmembers present, was adopted; and the City Clerk was instructed that Motion ~X, <br />,the resolution of vacation is not to be recorded until the conditions have been Second ,X, <br />,satisfied.
