The hearin~ <br /> :on the appeal of the environmental findings had been continued from December 13, 1983, <br /> :when the City Council requested the Plannin~ Department to advertise the necessary <br /> :notice of intention to adopt a negative declaration for Cases GP-7-83~ and R-17-834, <br /> ~and was a~ain continued from January 10, 198~, to permit the joint bearings. As <br /> :heretofore directed by the City Council, the minutes of the City Plannin~ Commission <br /> :and the Environmental Proteczion Commission pertainin~ to these cases are on file and <br /> :are a part of the evidence submitted at this hearing, whether or not an~ portion <br /> :thereof is read or discussed. The communication from the City Plannin~ Commission <br /> :stated that the Commission, by a vote of 8 ayes to 0 noes, approved the Retail Business <br /> :and Office land use designation and Zone C-2, the rezonin~ bein~ subject to the follow- <br /> :in~ conditions: (1) There shall be a Uwo-~ear time limit in which ~o satisfy the <br /> !followin~ conditions and finalize this action. If the zonin~ is not adopted within <br /> :two years af the dare of inuroduction of the ordinance, the action taken on this <br /> :petition shall be void. A time extension of not more than one year may be requested <br /> ~of the City Council by letter. Such time extension request must be received by =he <br /> ~Cit~ Clerk 30 days prior to the end of the two-year limit; (2) All utilities shall be <br /> satisfactorily relocated, protected and/or replaced to the specifications of the <br /> affected departments and a~encies, and easements for such facilities retained as <br /> necessary; (3) The Legal Department shall be requested to prepare, within 30 days of <br /> the date of approval of this case, the necessaz7 resolution for Ci=7 Council adoption <br /> of the subject General Plan amendmen=~ (~) Deed for widenin~ lndiana Avenue to ~ feet <br /> from monument centerline to Public Works Depar=menE specifications; (5) Installation <br /> of curb and ~ut=er at 32 feet from monument centerline, sidewalk and matchin~ pavement <br /> on Indiana Avenue to Public Works Department specifications; (6) Installation af a <br /> Class I1 bikeway on La Sierra Avenue to Public ~orks Department specifications; <br /> (7) Storm drain construction will be contingent on en~ineer~s drainage study~ (8) Deed <br /> for widenin~ La Sierra Avenue to 55 feet where needed from monument centerline to Pub- <br /> lic Works Department specifications~ (9) Installation of curb and ~utter at ~3 feet <br /> from monument centerline, sidewalk and matchin~ pavement on La Sierra Avenue to Public <br /> :Norks Department specifications~ (10) All property subjecz to floodin~ from 100-year <br /> :storm shall be placed in Zone WC prior to or concurrentiV with the final adoption of <br /> :this zonin~ case; (11) 0ff-si~e improvement plans to be approved by Public Works De- <br /> :partmerit and a surety posted to ~uarantee the required off-site improvements prior to <br /> :the final adoption of this zonin~ case; (12) Removal and/or relocation of irri~ation <br /> :facilities~ (13) Removal and/or relocation of trees as required~ (1~) Cash payment for <br /> :one-third the cost of zhe future median construction in La Sierra Avenue =o Public <br /> :~orks Departmen~ specificanions~ (15) Developer is responsible no have a traffic ~ener- <br /> :a~i0n s~ud~ prepared and appr0ved bV ~he Public Works Depot=men= prior ~o ~he [inal <br /> |adoption of ~his zonin~ case ~o determine if u=affic signal facilizies are warranted au <br /> :Indiana Avenue and Ls Sierra Avenue. ~£ ei~nale are war=anted, 8evelo~er ~ill be ~e- <br /> ~nsible to insnall the traffic signal facilities to Public Works Depar:ment specif~- <br /> ~ Ions. The Plannin~ Director presented departmen- <br /> :tal recommendations, ~o~ether with. maps of the area, and reviewed the actions taken to <br /> idate. No one was present wishin~ to speak on the matter. No written protests were <br /> :presented. The hearin~ was officially closed. The appeal was ~ranted, and it was de- <br /> :termined that the General Plan amendment and =he rezonin~ would nat have a significant <br /> :adverse environmental effec~ and the staff report and the environmental assessment <br /> :were adopted as findings. The proposed General Plan amendment was approved as recom- <br /> :mended by the CitN Plannin~ Commission~ and the Ci=7 Attorney was requested to prepare Motion ,X, <br /> :the appropriate resolution for adoption.
