<br />PUBLIC HEARINGS BEFORE THE CITY COUNCIL AT 3:00 P.M.

<br />CASE VAC-10-845 - VACATION OF PORTION OF OLD CENTRAL AVENUE - APPROVED - RESOLUTION
<br />3:00 P.M.--Hearing was called on ResolUtion No. 15681, adopted March 26, 1985, for
<br />~the proposed vacation of a portion of old Central Avenue approximately 60 feet wide
<br />~by 1,113 feet long, extending from approximately 440 feet west of Acorn Street to
<br />~Doolittle Avenue and located both east and west of Van Buren Boulevard, Case
<br />~VAC-10-845. As heretofore directed by the City Council, the mutes of the City
<br />Planning Conm~ission and the Environmental Protection Connnission pertaining to this
<br />,matter are on file and are a part of the evidence submitted at this hearing, whether
<br />~or not any portion thereof is read or discussed. The counnunication from the City
<br />Planning Commission stated that the Commission, by a vote of 8 ayes to 0 noes, ap-
<br />tproved the proposed vacation subject to the following conditions: (1) This vacation
<br />shall be by resolution or as otherwise approved by the Legal Department; (2) The
<br />Legal Department shall determine which, if any, nearby property owners will be signif-
<br />icantly affected by the vacation action, and the applicant shall provide the appropri-
<br />ate Hold Harmless documents to the specifications of the Legal Department; (3)'All
<br />utilities shall be satisfactorily relocated, protected and/or replaced to the specifi-
<br />cations of the affected departments and agencies, and easements for such facilities
<br />retained as necessary; (4) The fee-owned triangular parcel, purchased for severance,
<br />shall be assigned to Airport control by minute action of the City Council. If this
<br />,parcel was acquired with money from a designated fund, its cost will have to be
<br />reimbursed from Airport funds; and (5) A private roadway easement to Komfort Indus-
<br />~tries, lying within the boundary of the Airport adjacent to the newly-acquired Clear
<br />~Zone, shall be extended southeasterly, across the vacated parcel to the retained
<br />~right-of-way by ~asement reservation in the resolution of vacation. The communication
<br />~from the Environmental Protection Commission advised that =he Commission, by a
<br />iof 8 ayes to 0 noes, determined that the proposed vacation would not have a signifi-
<br />,cant adverse effect on the environment. The Planning Department presented departmentab
<br />recommendations, together with maps o~ the area. No one was present wishing to speak
<br />on the matter. No written protests were presented. The hearing was officially
<br />closed. The vacation was approved subject to the recoupmended conditions; iU was
<br />determined that the proposed vacation would not have a significant adverse environmen-
<br />tal effect; and the staff report and the environmental assessment were adopted as
<br />findings. Resolution No. 15705 of the City Counci~ of the City of Riverside, Califor-
<br />nia, Making Its Findings and Determinations in the Matter of Resolution of intention
<br />No. 15681; and Making Its Order Vacating a Portion of Old Central Avenue, West of
<br />Acorn Street and Extending to Doolittle Avenue, was presented; and the title having
<br />been read, and further reading waived by the unanimous consent of Councilmembers
<br />~present, was adopted; and the City Clerk was instructed that the resolution of
<br />=vacation is not to be recorded until the conditions have been satisfied.

<br />~3:00 P.M.--Hearing was called on the appeal of Cynthia Marquez relative to the
<br />~decision of the City Planning Commission regarding the request of Fred S. Meyer to
<br /> place the approximately 35.66 vacant acres of land on the east and west sides of
<br />=Alessandro Boulevard in the 6400 block, situated southerly of Whitestone Drive and
<br />~Dolphin Street, in Zones K-1-80 and R-1-100 and remove the same from Zones R-I-130
