Should the properties be reco~nized as separate lots, they <br /> shall be consolidated into a single parcel by parcel map waiver but without further Plan- <br /> ning Commission Action; (6) No Jud~nnent is made under this rezoning case as to the ac- <br /> ceptability of the related conditional use permit, Zoning Case C-42-878; (7) Deed for <br /> widening Hole Avenue to 44 feet from monument centerline to Public Works Department <br /> specifications; (8) Installation of curb and gutter at 32 feet from monument centerline, <br /> sidewalk and matchin~ pavement on Hole Avenue to Public Works Department specifications; <br /> (9) Removal of existinS improvements on Hole Avenue; (10) Storm drain construction gill <br /> be contingent on engineer's drainage study; (11) Off-site improvement plans to be ap- <br /> proved by the Public Works Department and a surety posted to guarantee the required <br /> off-site improvements prior to final adoption of this zoning case; and (12) Size, n~unber <br /> and locations of driveways to Public Works Department specifications; determined that <br /> the proposed rezoning would not have a significant adverse environmental effect; and <br /> adopted the staff report and the environmental assessment as findings. The <br /> hearing gas officially closed. Zones C-2-S-2-X were approved, subject to the recom- <br /> mended conditions; it was determined that the rezoninS would not have a significant ad- ZMotion <br /> verse environmental effect; the staff report and the environmental assessment were adopt- Second :X~ <br /> ed as findings; and the ordinance was introduced. All Ayes <br /> <br /> FURTHER HEARING - ZONING CASE R-41-812 - INDIANA AND MADISON - TIME EXTENSION REQUEST - <br /> CONTINUED <br /> 3 P.M.--Further hearing was called on the request of Joseph N. Beelet, J. N. Beelet and <br /> Associates, on behalf of C. L. Smith, for a one-year time extension in which to complete <br /> the conditions of approval under Zoning Case R-41-812, relating to property totaling ap- <br /> proximately 5.5 acres of land at 7340-7360 Indiana Avenue, 7438-7454 Indiana Avenue, <br /> 7474 Indiana Avenue and 3311 Madison Street, situated on the southeasterly side of Indi- <br /> ana Avenue and northeasterly side of Madison Street. Petition for a zone change ~rom <br /> Zones R-1-65 and C-3 to Zones C-3 and YS was granted on September 21, 1982; and this is <br /> the fourth request for a time extension. This case has been active for five years or <br /> more and requires a public hearing prior to granting a time extension. Failure to <br /> approve the time extension request will rescind the tentatively-approved C-3 and YS zon- <br /> ing. The hearing had been continued from April 19, 1988, at the request of the appli- <br /> cant. The Plannln8 Director presented a written report recoBnendinS that the City Coun- <br /> cil (1) grant a final two-year time extension in which to finalize Zoning Case R-41-812; <br /> and (2) reintroduce the rezoninS ordinance to apply Zone C-2 to the entire subject prop- <br /> erty, together with Zone S-2 (Two-Story) and Zone X (ten-foot setback from Indiana Ave- <br /> nue); subject to the followinS conditions: (a) all conditions previously approved on <br /> September 12, 1982, which are still pertinent; (b) the new expiration date of April 26, <br /> 1990; and (c) the alternate zoning classifications indicated in Recommnendation (2) <br /> above. Mr. Beelet spoke in support of the extension of time in which to finalize Zones <br /> C-3 and YS. One ~ritten protest was presented and considered. No oral protests were <br /> presented. Following discussion, the hearing gas continued to June 7, 1988, at <br /> 1:30 p.m.; and the City Council Utility Services/Land Use/Energy Development Committee Motion <br /> was requested to consider the matter, and present its recommendations to the City Coun- Second <br /> nil.
