<br />the following variance to construct a two-story office building at 5041 La Mart Drive,
<br />situated on the west side of La Mart Drive northerly of E1 Cerrito Drive, in Zones
<br />RO-S-I-X and RO-S-2-X: to allow an office building with an overall building height of
<br />up to 32 feet where a maximum height of 30 feet is permitted; and determined that the
<br />proposal would not have a significant adverse effect on the environment. It was deter-
<br />mined that the City Council would not set the matter for public hearing.

<br />ENVIRONMENTAL PROTECTION COMMISSION

<br />CASE EPC-52-878 - PROPOSED GRADING PLAN - 7655 DUFFERIN
<br />A communication was presented from the Environmental Protection Commission advising
<br />that, on March 9, 1988, the Commission, by a vote of 10 ayes to 0 noes, determined that
<br />the proposed grading plan for a single-family residence on a vacant 5.7-acre lot at
<br />7655 Dufferin Avenue, generally situated on the northwesterly side of Dufferin Avenue
<br />northeasterly of Grace Street, in Zone RA, could have a significant effect on the envi-
<br />ronment, but will not in this case if certain mitigating measures are required as part
<br />of the conditions of approval of the project, Case EPC-52-878. The Commission's finding
<br />was upheld by the City Council.

<br />TIME EXTENSION ON CONDITIONS OF APPROVAL - ZONING CASE R-71-778
<br />A communication was presented from John Jordan, Albert A. Webb Associates, on behalf of
<br />Donna Elliott, requesting a one-year extension of time from March 28, 1988, in which to
<br />complete the conditions of approval under Zoning Case R-71-778, being the approximately
<br />.78 acre of land situated on the southerly side of Arlington Avenue easterly of Monroe
<br />Street, located in the 6800 block of Arlington Avenue. Petition for a zone change from
<br />Zone R-1-65 to Zones C-2-S-1-X was granted on March 28, 1978; and this is the ninth re-
<br />quest for a time extension. The time extension was granted to March 28, 1989, retro-
<br />active to March 28, 1988. (This case has been active over five years and received a
<br />time extension to March 25, 1988, following a public hearing by the City Council on
<br />April 7, 1987. The City Council has recently clarified the time extension policy to al-
<br />low one final two-year time extension as a result of the time extension public hearing.
<br />On that basis, a final one-year time extension for this case may be considered. No fur-
<br />ther extensions may be approved beyond March 28, 1989.)

<br />TIM EXTENSION ON CONDITIONS OF APPROVAL - ZONING CASE R-67-790
<br />A communication was presented from John Jordan, Albert A. Webb Associates, on behalf of
<br />William Bruno, requesting a one-year extension of time from March 25, 1988, in which to
<br />complete the conditions of approval under Zoning Case R-67-790, being the approximately
<br />18.81 acres of land situated on the southerly side of Eastridge Avenue (extended) wester-
<br />ly of Brown Street. Petition for a zone change from Zone RA-2 to Zone MP was 8ranted on
<br />March 25, 1980; and this is the seventh request for a time extension. The time exten-
<br />SiOn was granted to March 25, 1989, retroactive to March 25, 1988. (This case has been
<br />active over five years and received a time extension t0 March 25, 1988, f0110wing a pub-
<br />lic hearing by the City Council on April 7, 1987. The City Council has recently clari-
<br />fied the time extension policy to allow one final two-year time extension as a result of
<br />the time extension public hearing. On that basis, it appears reasonable to allow a fi-
<br />nal one-year time extension for this case to March 25, 1989.)

<br />A communication was presented from Philip G. Osborn requesting a one-year time extension
<br />from February 10, 1988, in which to complete the conditions of approval under Zoning
<br />Case R-33-801, being approximately .17 acre of land at 9057 Magnolia Avenue, situated on
<br />the northwesterly side of Magnolia Avenue northeasterly of Jackson Street. Petition for
<br />a zone change from Zone R-1-65 to Zone RO was granted on February 10, 1981; and this is
<br />the sixth request for a time extension. The time extension was granted to February 10,
<br />1989, retroactive to February 10, 1988. (This case has been active over five years and
<br />received a time extension to February 10, 1988, following a public hearing by the City
<br />Council on April 7, 1987. The City Council has recently clarified the time extension
<br />policy to allow one final two-year time extension as a result of the time extension pub-
<br />lic hearing. On that basis, it appears reasonable to allow a final one-year time exten-
<br />sion for this case to February 10, 1989.)
