He also spoke regarding the drainage and flow of <br /> water. Jenny Haguewood, 11037 Kayjay Street, stated she liked the <br /> orange groves and was concerned with her loss of privacy. She also felt <br /> the Street "A" was too close to the intersection of Victoria and La Sierra <br /> and did not want 2-story homes built. Staff and Mr. Ingersoll responded to <br /> some of the concerns expressed at the request of the Chairman. <br /> Following discussion the Planning Commission recommended that the <br /> City Council: 1) Determine that Planning Case P14-0176 will not have a Motion M <br /> significant effect on the environment based on the findings set forth in the Failed <br /> case record and recommend adoption of a Mitigated Negative <br /> Declaration; 2) Recommend adoption of the Mitigation Monitoring and <br /> Reporting Program pursuant to Sections 15097 and 21081.6 of the Public <br /> Resources Code; and 3) Approve Planning Case P14-0176 based on the <br /> findings in the staff report and subject to the recommended conditions <br /> with the following additions: That the drainage channel be looked at, as <br /> far as being either deeper or wider to make sure there isn't a flooding <br /> problem. Motion failed due to lack of second. <br /> SUBSTITUTE MOTION: The Planning Commission recommend that the <br /> City Council: 1) Determine that Planning Case P14-0176 will not have a Motion M <br /> significant effect on the environment based on the findings set forth in the Second S <br /> case record and recommend adoption of a Mitigated Negative Ayes X X X <br /> Declaration; 2) Recommend adoption of the Mitigation Monitoring and No X <br /> Reporting Program pursuant to Sections 15097 and 21081.6 of the Public <br /> Resources Code; and 3) Approve Planning Case P14-0176 based on the <br /> findings in the staff report and subject to the recommended conditions <br /> with the following additions: 1) Lots 4,5, 6 and 14 be single story homes. <br /> 2) The timing for the grading of the site shall be such that the existing <br /> grove not be removed until the grading permit is pulled. 3) On site fruit <br /> trees shall be preserved where possible. Where preservation of existing <br /> trees is not possible on each lot, fruit bearing trees shall be planted in a <br /> grove like manner and included as such in the project landscape plans to <br /> the satisfaction of the Planning Division staff. <br /> PLANNING CASE P14-0501, P14-0529, P14-0530 — NWly corner of the <br /> intersection of La Sierra Avenue and Pierce Street <br /> Proposal by Chris Peto on behalf of Comsite, to consider 2) a Conditional <br /> Use Permit for a drive-thru fast-food restaurant; 2) a Conditional Use <br /> Permit for a Pharmacy drive-thru; 3) Design Review of plot plan and <br /> building elevations for the development of a commercial shopping center <br /> on a vacant site.
