PLANNING CASES P14-0026 and P14-0027— 10952 Magnolia Avenue Proposal by McDonalds Corporation, LLC for consideration of a Conditional Use Permit to permit a drive through business ("McDonalds"), and for Design Review of the plot plan and building elevations related to the construction of an approximately 5,160 square foot fast food restaurant including an indoor play area, indoor and outdoor eating areas, an approximately 220 foot long "side-by-side" drive thru, and variance related to screening from an adjacent undeveloped residentially zoned parcel is requested. There were no comments from the audience. Following discussion the Planning Commission recommended that the City Council: 1) Determine that the proposed project will not have a Motion M significant effect on the environment based on the findings set forth in the Second S case record and adopt a Negative Declaration; 2) Approve Planning Ayes X X X X X X Cases P14-0026 and P14-0027 and related variance based on the findings outlined in the staff report and subject to modified conditions. The Planning Commission recommended modified conditions include: 1) The applicant work with staff to integrate materials, colors, massing of the existing center on the new building design. 2) Install a speed bump at the entrance of the east side of the building. 3) Modify the green screen by rearranging the canopy to allow pedestrian visibility. PLANNING CASE P13-1020 — 4011 Fairgrounds Street CONTINUED TO OCTOBER 23, 2014 Brian Norton announced that a letter from a concerned citizen was received yesterday and the applicant is requesting a continuance to address the citizen's concerns. Shanna Reyes, Smartlink, on behalf of Verizon Wireless, stated that the request for continuance is to address a late notice received from an adjacent neighbor. They would like to have time to address the neighbor's concerns and comments. She apologized for the late request for continuance. No one requested to speak to the Motion M continuance.
