' City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: October 4, 2011 <br />FROM: PUBLIC WORKS DEPARTMENT ITEM NO: 19 <br />WARDS: ALL <br />SUBJECT: RIVERSIDE REGIONAL WATER QUALITY CONTROL PLANT PHASE 1 <br />EXPANSION — FIRSTAMENDMENTTO THE AGREEMENT FOR THE MEMBRANE <br />BIOREACTOR SYSTEM <br />ISSUE <br />The issue for City Council consideration is approval of a First Amendment to the Agreement with <br />Zenon Environmental Corporation, doing business as GE Water & Process Technologies (GE) for <br />the membrane bioreactor (MBR) system to be supplied for the Riverside Regional Water Quality <br />Control Plant (WQCP) Phase 1 Expansion. Under the proposed First Amendment, GE would supply <br />a new generation of an MBR system which would reduce construction costs and provide a <br />guaranteed reduction in energy usage. <br />RECOMMENDATION <br />That the City Council approve a First Amendment to the Agreement with GE to supply an MBR <br />system and related services for the WQCP Phase 1 Expansion at a cost not -to- exceed $330,416. <br />COMMITTEE RECOMMENDATION <br />On August 31, 2011, the Utility Services /Land Use /Energy Committee, with Chair Bailey, Vice Chair <br />Gardner and Member Davis present, unanimously recommended that the City Council approve a <br />First Amendment to the Agreement with GE. <br />BACKGROUND <br />On October 26, 2010, the City Council approved an Agreement with GE to supply an MBR system <br />and related services for the WQCP Phase 1 Expansion at a cost not -to- exceed $17.6 million. This <br />not -to- exceed cost includes $15,954,801 for the cost for the MBR system, plus a 10% change order <br />allowance for deviations from the scope of work as the design progresses from 30% to 100% <br />completion. Only one (1) design change has occurred to date resulting in a cost increase of <br />approximately $60,000. <br />In July 2011, after 18 months of real world testing, GE introduced a new generation of MBR systems <br />(LEAPmbr) and proposes to incorporate the new system into the WQCP Phase 1 Expansion. <br />19 -1 <br />
