P08 -0306 • Page 2 <br />In March 2011, the applicant submitted a revised version of this vacation case, which consists <br />only of an approximately 66 foot wide by 138 long "paper street" segment of Ninth Street over <br />the aforementioned ATS &F railroad tracks. This vacation is only intended to give RCTC clear <br />title for access to the aforementioned railroad tracks. <br />As the revised vacation involves less area but still falls entirely within the boundaries of the <br />previously approved vacation, the current request is in substantial conformance with the <br />original approval. However, as existing drive aisles and parking areas are no longer within the <br />area to be vacated, a revised set of recommended conditions of approval are attached to this <br />report removing any conditions related to aspects of the project no longer within the area to be <br />vacated. Further, the adopted Mitigated Negative Declaration on November 18, 2008 is still <br />applicable to this revised vacation. <br />Additional background on the original approval can be found in the attached staff report <br />(Attachment 5).
