City Council Memorandum <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: MAY 10, 2011 <br />FROM: COMMUNITY DEVELOPMENT DEPARTMENT ITEM NO: 19 <br />PLANNING DIVISION <br />WARD: 2 <br />SUBJECT: PLANNING CASE P08 -0306 (REVISED) — VACATION OF AN <br />APPROXIMATELY 66 -FOOT WIDE BY 138 -FOOT LONG PORTION OF NINTH <br />STREET — SITUATED WITHIN THE EXISTING RAILROAD, EASTERLY OF <br />SANTA FE AVENUE — ADOPTION OF RESOLUTION <br />ISSUE: <br />To consider a proposal by Epic Land Solutions, Inc. to vacate approximately 2,508 square feet <br />of Ninth Street, situated within existing railroad right -of -way, easterly of Santa Fe Avenue. This <br />street vacation adoption request represents a modified version of a street vacation approved <br />by the City Council on November 18, 2008 as will be detailed below. <br />RECOMMENDATION <br />That the City Council adopt the attached Resolution for Planning Case P08 -0306 (Revised) <br />approving the street vacation pursuant to the findings found in the attached resolution and <br />subject to the to the original Planning Commission findings and revised conditions of approval. <br />STAFF /PLANNING COMMISSION RECOMMENDATIONS <br />On September 18, 2008, the City Planning Commission approved Planning Case P08 -0306 by <br />a vote of 8 ayes, 0 noes and 0 abstentions subject to staff's recommended conditions. On <br />November 18, 2008, the City Council adopted Resolution No. 21749 to approve the street <br />vacation and adopt a Mitigated Negative Declaration by a vote of 6 ayes, 0 noes and 0 <br />abstentions. <br />BACKGROUND <br />The City Council approved version of this street vacation involved approximately 220 - lineal <br />feet of Santa Fe Avenue, between Jack B Clarke Way and Ninth Street; 65 lineal feet Jack B. <br />Clarke Way, easterly of Santa Fe Avenue; and 303 lineal feet of Ninth Street, east of Vine <br />Street to its terminus across the ATS &F railroad tracks. This vacation, as originally approved, <br />was intended to facilitate pedestrian and vehicular access and create additional parking areas <br />for the adaptive reuse of the Riverside Packing House at the northeast corner of Santa Fe <br />Avenue and Ninth Street. However, the Riverside Packing House adaptive re -use project is no <br />longer being pursued. Therefore, the street vacation, in its full original form as previously <br />approved is no longer needed. <br />19 -1 <br />
