1 current and immediate threat to the public health, safety and welfare base on significant negative 2 compatibility problems such as heavy automobile traffic and negative aesthetic impacts often 3 associated with garages on the sensitive street frontages which exist along the General Plan's 4 designated Scenic Boulevards; and 5 WHEREAS, the City Council finds that it is necessary and proper to adopt this urgency 6 measure to establish a temporary moratorium on the acceptance of any application for the expansion 7 of or establishment of a new automobile repair facility in the C-3 Zone along General Plan 8 designated Scenic Boulevards to preclude such uses which are in conflict with a contemplated 9 zoning amendment which the Planning Department is currently studying and intends to further 10 study within a reasonable time; and 11 WHEREAS, the City Council finds that it can be seen with a certainty that there is no 12 possibility that the adoption of this interim zoning ordinance will have a significant adverse effect 13 on the environment; 14 NOW, THEREFORE, pursuant to Section 200 and 413 of the Charter of the City of 15 Riverside and Section 65858 of the Government Code of the State of California, the City Council of 16 the City of Riverside, Califomia does ordain as follows: 17 SectiOn 1: The City Council hereby incorporates by reference all of the above stated 18 findings as if fully set forth herein. 19 Section 2: A temporary moratorium on the filing of any application with the City of 20 Riverside Planning Department for the expansion of or establishment of new automobile garages 21 pursuant to Riverside Municipal Code Section 19.36.020 B.3. in the C-3 (General Commercial) 22 Zone on property located on any Scenic Boulevard designated on the Transportation Element of the 23 General Plan for the City of Riverside is hereby established. 24 Section 3: The provisions of this ordinance shall not apply to any application for a 25 building permit, including building permits for tenant improvements within an existing building, if 26 such plans for such use were submitted for plan check with the Building Division of the City of 27 Riverside as of June 1, 1999; provided, however, the provisions of this ordinance shall apply if a CiW Attorney's Office 3900 Main Street Riverside, CA 92522 (909) 782-5567 15 -4 -2-
