1 current and immediate threat to the public health, safety and welfare base on significant negative <br />2 compatibility problems such as heavy automobile traffic and negative aesthetic impacts often <br />3 associated with garages on the sensitive street frontages which exist along the General Plan's <br />4 designated Scenic Boulevards; and <br />5 WHEREAS, the City Council finds that it is necessary and proper to adopt this urgency <br />6 measure to establish a temporary moratorium on the acceptance of any application for the expansion <br />7 of or establishment of a new automobile repair facility in the C-3 Zone along General Plan <br />8 designated Scenic Boulevards to preclude such uses which are in conflict with a contemplated <br />9 zoning amendment which the Planning Department is currently studying and intends to further <br />10 study within a reasonable time; and <br />11 WHEREAS, the City Council finds that it can be seen with a certainty that there is no <br />12 possibility that the adoption of this interim zoning ordinance will have a significant adverse effect <br />13 on the environment; <br />14 NOW, THEREFORE, pursuant to Section 200 and 413 of the Charter of the City of <br />15 Riverside and Section 65858 of the Government Code of the State of California, the City Council of <br />16 the City of Riverside, Califomia does ordain as follows: <br />17 SectiOn 1: The City Council hereby incorporates by reference all of the above stated <br />18 findings as if fully set forth herein. <br />19 Section 2: A temporary moratorium on the filing of any application with the City of <br />20 Riverside Planning Department for the expansion of or establishment of new automobile garages <br />21 pursuant to Riverside Municipal Code Section 19.36.020 B.3. in the C-3 (General Commercial) <br />22 Zone on property located on any Scenic Boulevard designated on the Transportation Element of the <br />23 General Plan for the City of Riverside is hereby established. <br />24 Section 3: The provisions of this ordinance shall not apply to any application for a <br />25 building permit, including building permits for tenant improvements within an existing building, if <br />26 such plans for such use were submitted for plan check with the Building Division of the City of <br />27 Riverside as of June 1, 1999; provided, however, the provisions of this ordinance shall apply if a <br /> <br />CiW Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 782-5567 <br /> <br />15 -4 <br /> -2- <br /> <br /> <br />
