1 ORDINANCE NO. <br /> <br /> 2 AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, ESTABLISHING <br /> A TEMPORARY MORATORIUM ON THE ACCEPTANCE OF APPLICATIONS <br /> 3 FOR AUTOMOBILE GARAGE, PUBLIC OR PRIVATE, INCLUDING INCIDENTAL <br /> AUTOMOBILE PAINTING, AND BODY AND FENDER WORK FOR THOSE <br /> 4 PROPERTIES LOCATED IN THE C-3 (GENERAL COMMERCIAL) ZONE AND <br /> LOCATED ALONG THE SCENIC BOULEVARDS AS DESIGNATED IN THE <br /> 5 GENERAL PLAN WITHIN THE CITY OF RIVERSIDE FOR A PERIOD OF 45 DAYS <br /> PURSUANT TO GOVERNMENT CODE SECTION 65858; AND DECLARING THIS <br /> 6 ORDINANCE TO BE AN URGENCY MEASURE. <br /> <br />7 WHEREAS, automobile repair garages, including incidental automobile painting and <br />8 body and fender work are currently permitted in the C-3 (General Commercial) Zone pursuant 'to <br />9 Riverside Municipal Code Section 19.36.020 B.3., without review by the Planning Commission or <br />10 the City Council, and such uses will result in the creation of significant negative land use <br />11 compatibility problems on properties with sensitive street frontages; and <br />12 WHEREAS, the Planning Department of the City of Riverside is currently engaged in the <br />13 completion of the Magnolia/Market Corridor Study and the Arlington Community Study~ in which <br />14 the study areas include Scenic Boulevards which are designated on the Transportation Element of <br />15 the General Plan, to determine the appropriate zoning and regulation of compatible land uses within <br />16 those areas and along the Scenic Boulevards located in those study areas; and <br />17 WHEREAS, the current studies have not been completed; and <br />18 WHEREAS, the Planning Department will undertake an additional study of appropriate <br />19 land uses in the C-3 Zone located along all the General Plan designated Scenic Boulevards in the <br />20 City relative to automobile garages and will recommend appropriate amendments to the Zoning <br />2 1 Code, including proposed development standards, and potentially requiring the issuance of a <br />22 conditional use permit for any new automobile repair or service garage proposed to be located in the <br />23 C-3 Zone and located on any Scenic Boulevard designated on the General Plan; and <br />24 WHEREAS, the City Council finds that the expansion of or establishment of new <br />25 automobile repair garages, including incidental automobile painting and body and fender work, in <br />26 the C-3 Zone and on Scenic Boulevards designated on the Transportation Element of the General <br />27 Plan, without appropriate development standards or the requirement of a conditional use permit is a <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 782-5567 <br /> <br />15-3 <br /> <br /> <br />
