Council Memorandum • Pa,e 2 <br />BACKGROUND: <br />In March 2009, George Spiliotis, Executive Officer of LAFCO, notified the City of Riverside of <br />Jurupa Valley's efforts to circulate a petition for incorporation. Jurupa Valley consists of the areas of <br />Mira Loma, Sky Country, Glen Avon, Pedley, Sunnyslope, Indian Hills, Jurupa Hills, Rubidoux and <br />Belltown. See Attachment 1 of the May 14, 2009 Land Use Committee Staff Report (Attachment 6 <br />of this report). <br />The southern boundary of the proposed incorporation abuts the current northern boundary of the <br />City of Riverside and includes much of the Santa Ana River, as well as sites and facilities on the <br />southerly side of the river that can only be served by the City of Riverside, including private <br />properties and City-operated utility and sewer infrastructures. <br />One such facility is the Santa Ana River Trail. As indicated on Attachment 2 of the June 11, 2009 <br />Land Use Committee Staff Report (Attachment 7 of this report), the Santa Ana River Trail is jointly <br />maintained by both the City of Riverside and the County, with each agency maintaining individual <br />segments. Some portions of the City-maintained segments are currently north of the City limits, but <br />all segments are located and accessed from the southerly side of the Santa Ana River. This trail <br />cannot be directly accessed from the proposed Jurupa Valley side of the Santa Ana River; <br />therefore, it is recommended that this entire trail be located within the City of Riverside, with no <br />portions located within the proposed City of Jurupa Valley. <br />At the May 14, 2009 and June 11, 2009 meetings, the Land Use Committee reviewed the proposed <br />boundaries of the Jurupa Valley incorporation and recommended moving City limit boundaries to <br />the north ensure the ability of the City of Riverside to effectively serve those private properties, City <br />operated utility and sewer infrastructures and the Santa Ana River Trail (Attachments 1 through 5). <br />These areas could not effectively be served by the proposed City of Jurupa Valley. <br />FISCAL IMPACT: <br />The LAFCO filing fees for increasing the City's sphere and annexing the additional properties into <br />the City, including the cost of filing the annexation, sphere boundary amendment, and any <br />necessary municipal services review, are $13,800 plus the State Board of Equalization (SBOE) fees <br />of $7,750 ($21,550 total). However, since it is the incorporation of Jurupa Valley that is <br />necessitating City review of a sphere boundary amendment, annexation, and any necessary <br />municipal services review, all LAFCO fees should be waived or borne by the Jurupa Valley <br />incorporation efforts. Staff recommends that the City Council formally forward this position to <br />LAFCO. <br />Another fiscal concern is the potential use of County funds to support municipal services of the <br />newly incorporated City. In so doing, it reduces the County's ability to fund municipal projects <br />outside of the newly incorporated area. While this is not directly part of the boundary review <br />currently under consideration, it is recommended that this position be forwarded to LAFCO at the <br />earliest opportunity. <br />32-2 <br />
