City Council Memorandum <br />. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . <br />TO: HONORABLE MAYOR AND CITY COUNCIL DATE: July 14, 2009 <br />FROM: COMMUNITY DEVELOPMENT DEPARTMENT ITEM NO: 38 <br />CODE ENFORCEMENT DIVISION <br />WARDS: ALL <br />SUBJECT: RECOVERY OF FISCAL YEAR 2008-09 UNPAID ACCOUNTS OF CITATIONS AND <br />ABATEMENTS - RESOLUTIONS <br />ISSUE: <br />The issue to be considered by the City Council is whether to approve the Accounts of Citations and <br />Abatements contained in Exhibits A through J of this report and adopt the correlating Resolutions <br />that assess the charges as tax liens upon the respective properties. <br />RECOMMENDATIONS: <br />That the City Council: <br />Approve the Accounts of Citations and Abatements as contained in Exhibits A through J to <br />this report; and <br />2. Adopt the correlating Resolutions that assess the charges as tax liens upon the respective <br />properties. <br />BACKGROUND: <br />The Administrative Code Enforcement Program adopted by the City Council on July 13, 1999 <br />enables the Code Enforcement Division to employ appropriate means of cost recovery for citations, <br />abatement services, administrative fees, and personnel charges that may be incurred by the City <br />when owners do not voluntarily bring into compliance property violations of the Riverside Municipal <br />Code and/or the Uniform Code for Abatement of Dangerous Buildings and/or the California Building <br />Code. When all means of notification, order and appeal have been utilized to garner voluntary <br />compliance, the Code Enforcement Division proceeds with abatement action by a contractor. The <br />City then invoices the property owners to collect the amounts of the fees and charges that have <br />been incurred. With regards to citations, all reasonable efforts are made by Code Enforcement <br />Division staff to ensure compliance with all applicable City codes. Often these actions result in the <br />issuance of Administrative Citations, per the City Council approved Resolution. <br />If, after utilizing all means of notification, invoicing and collection to recover costs from the property <br />owners, there is debt remaining unpaid for thirty days or more, the City may, after City Council <br />adoption of the necessary resolution, have the County Auditor attach a lien on the respective <br />property tax statements to recover the outstanding costs.
