2 1 y4" ;I 41~ R I 3 City Council Memorandum TO: HONORABLE MAYOR AND CITY COUNCIL DATE: June 9, 2009 FROM: COMMUNITY DEVELOPMENT DEPARTMENT ITEM NO: 27 PLANNING DIVISION WARD: 5 SUBJECT: PLANNING CASES P09-0205 (TPMM) AND P09-0206 (VC) - TRAFFIC PATTERN MODIFICATIONS AT THE INTERSECTION OF DUFFERIN AVENUE AND STEWART STREET, AND VACATION OF PORTIONS OF DUFFERIN AVENUE BETWEEN STEWART STREET AND McALLISTER PARKWAY - RESOLUTION OF INTENT TO HOLD A PUBLIC HEARING ISSUE: The City Council is requested to set a public hearing on July 14, 2009 to consider a Traffic Pattern Modification Measure (TPMM) case for proposed modifications to existing traffic patterns on Dufferin Avenue at Stewart Street, and a Street Vacation (VC) case for vacation of portions of Dufferin Avenue, between Stewart Street and McAllister Parkway. Proposed modifications include, but are not limited to the construction of a permanent knuckle at the intersection of Dufferin Avenue and Stewart Street. RECOMMENDATION: That the City Council adopt the attached Resolution of Intent to Hold a Public Hearing, to be held on July 14, 2009 at 1:00 p.m. to consider Planning Cases P09-0205 and P09-0206. COMMITTEE RECOMMENDATION: On May 7, 2009, the City Planning Commission unanimously recommended approval of Planning Cases P09-0205 and P09-0206 by a vote of 5 ayes and 0 noes (4 absent), subject to the conditions of approval. BACKGROUND: Please refer to the attached City Planning Commission staff report and draft minutes dated May 7, 2009. FISCAL IMPACT: There is no fiscal impact associated with the adoption of the attached Resolution of Intent to hold a public hearing. Should the requested traffic pattern modification measures and vacation be approved at a duly noticed public hearing, the cost of all physical improvements associated with the project would be borne by the City, at an estimated cost of $80,000. 27-1
