Declarant is the foe owner andlor original developer of the following described <br />.real property situated in the Oity of Riverside, County of Riverside, State of Oalifarnia, <br />hereinafter referred to as Tact lVlap 311 ~7- ~ ~"T 31147- ~ and snore particularly described in <br />Exhlblt "A"►, which are attached hereto and incorporated herein by reference. <br />B. Declarant desires to itnprave and develop the fiats contained within TM 31147-1, <br />In connection with that development, Declarant has subrr~ltted to the Citry of Riverside ~"City"} certain grading plans for TM 3I147-1, which propose that overflow storm and drainage <br />waters <br />{"overflow"~ exit it onto Lot 3 of Tract Map 32165 recorded in Map Book 405, page 75-52, <br />~"TM 32I65"} into the existing pri~rate storm drain depicted and reserved an TM 32165. All <br />areas of the overflow systems shall be graded and finished with concrete watercourses to <br />channel the flow of the Overflow from the public street across the remainder lot of T1V131 I47-1 <br />to Lot 3 of T1VI 321 ~5 and hack into the downstream public street. <br />D. As a condition fax the acceptance of Declarant's grading plan far TM 31147-1 and <br />the issuance of building and grading permits, City is requiring that an agreement be executed and <br />recarded for the accaptance of overflow storm and drainage waters across TM 31147-1 onto TM <br />321 5 and to provide far the maintenance of the drainage facilitieslswales on the affec~ad lots by <br />the recording Qf a covenant. <br />
