1 <br /> <br /> 2 <br /> <br /> 3 <br /> <br /> 4 <br /> <br /> 5 <br /> <br /> 6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />13 <br /> <br />14 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />28 <br /> <br />RESOLUTION NO. 19416 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />RIVERSIDE AUTHORIZING COMMENCEMENT OF ACTION TO <br />DETERMINE THE VALIDITY OF SPECIAL TAXES TO BE <br />LEVIED ON PROPERTY WITHIN IMPROVEMENT AREA NO. 2 <br />OF COMMUNITY FACILITIES DISTRICT NO. 86-1 TO PAY THE <br />PRINCIPAL OF AND INTEREST ON THE OUTSTANDING <br />BONDS OF SUCH DISTRICT <br /> <br /> WHEREAS, on January 5, 1999, the City Council (the "City Council") of the City of <br />Riverside (the "City") adopted a resolution determining the results of a special election on the <br />proposition whether the Methodology for Determining and Apportioning Annual Amounts of Special <br />Taxes and Maximum Annual Amounts of Special Taxes (the "Methodology") for Community Facilities <br />District No. 86-1 of the City of Riverside, California (the "District") shall be modified by substituting <br />for Specific Plan Land Use Areas 5, 8, 11, 13, 14, 15, 16, 17, 18, 19, 21, 22, 23, 26 and 40, as <br />identified in the Methodology, the Rates and Method of Apportionment of Special Tax for <br />Improvement Area No. 2 of Community Facilities District No 86-1 of the City of Riverside, State of <br />California which is attached as Exhibit "B" to Resolution No. 19381 (the "Rates and Method of <br />Apportionment") and whether new special taxes shall be levied on the property within such <br />Improvement Area No. 2 ("Improvement Area No. 2") to pay a portion of the annual amount of the <br />principal of and interest coming due on the outstanding bonds of the District based upon the rates and <br />method of apportionment of special taxes which are set forth in the Rates and Method of <br />Apportionment; and <br /> <br /> WHEREAS, by said resolution the City Council determined that all votes cast in said <br />special election were in favor of such proposition and that such proposition carded; and <br /> <br /> WHEREAS, pursuant to Section 53359 of the California Government Code, the City <br />Council may order the commencement of an action to determine the validity of the special taxes to be <br />levied on property within Improvement Area No. 2, pursuant to the Rates and Method of <br />Apportionment, to pay the principal of and interest on the outstanding bonds of the District pursuant <br />to Chapter 9 (commencing with Section 860) of Title 10 of Part 2 of the California Code of Civil <br />Procedure; <br /> <br />RVPUB~RTA\54027 <br /> <br /> <br />
