VC-002-989 <br /> <br />RESOLUTION NO. 19413 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE, <br />CALIFORNIA, PROVIDING FOR THE SLIMMARY VACATION OF TWO <br />LETTERED REMNANT LOTS OF ADAMS STREET EXTENSION RIGHT-OF WAY, <br />LOCATED NORTH OF ARLINGTON AVENUE AND RESERVING PERMANENT <br />EASEMENTS AND RIGHTS OF WAY FOR THE FLIGHT AND PASSAGE OF <br />AIRCRAFT, AND FOR STORM DRAIN AND PUBLIC UTILITY PURPOSES. <br /> <br />1 <br /> <br />2 <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />6 WHEREAS, two lettered remnant lots of Adams Street extension right-of way, noah of <br />7 Arlington Avenue which were dedicated to the City for street purposes when the adjacent residential <br />8 subdivisions to the east were developed, are no longer required for street purposes and now <br />9 constitute excess fight of way and surplus property; and <br />10 WHEREAS, the extension of Adams Street was removed from the City's General Plan <br />11 Circulation Element in 1994; and <br />12 WHEREAS, applicant wishes to vacate the remnant rights-of-way with the vacated area <br />13 to be disposed of by operation of law between Harvest Christi-an Fellowship church to the west and <br />14 the adjacent residential property owners to the east; and <br />15 WHEREAS, notices regarding the proposed vacation have been sent to all affected parties <br />16 and agencies and no negative responses have been received; and <br />17 WHEREAS, Section 8330 et seq, of the Streets and Highways Code of the State of <br />18 California provide for the summary vacation of streets and public service easements under certain <br />19 conditions; and <br />20 WHEREAS, Section 8334 of the Streets and Highways Code provides that the legislative <br />21 body of a local agency may summarily vacate an excess right-of-way of a street or highway not <br />22 required for street or highway purposes; and <br />23 WHEREAS, the City Council wishes to proceed under the provisions of Sections 8330 et <br />24 seq. of the Streets and Highways Code to summarily vacate the hereinafter described two lettered <br />25 remnant lots of Adams Street Extension fight-of-way northerly of Arlington Avenue and to reserve <br />26 easements for the flight and passage of aircraft, and for storm drain and public utility purposes as <br />27 hereinafter described. <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(909) 782-5567 <br /> <br /> <br />
