[~HEREAs on November i3, i979; the City council of the city of Rivecside adopted ResolUtion No. 13822 declaring intention to okder the Vacati0h of a Portion of Fremoht Street and fiXing the 'time and place of hearing all persons ihterested in the proposed vacation, pUrsuaht to the " ' ~ provisions of the street Vaca6ion Act of 1941, being Section 8300 et seq. Of Part 3, DiviSion 9 of the Streets and Highways Code'of the State of California,'and WHEREAS said proposed vacation was submitted to and acted upon by the Planning Commission of khe City of Riverside and notice of hearing said ~esolUti~n.was given as provided by said Street Vacation Ac~ of 1941; and WHEREAS on .the day fixed for the hearing the City council heard and considered the evidence offered bY persons interested and found and hereby finds from'all of'the evidence submitte~ that the portion of Fremont Street ordered vacated is UnneCessary for present or prospective public use; ..
