MUNiCiPAb ~ODE <br />BY REPE~iNG SRC~ION 10,44~1i7 ~E~0F R~.t,A~iNG TO <br />pR0CEDU~d~S FOR ~ ~.NFORe~.MENT OF B~.~-~iON 223~0, <br />22507.8~ 23103 AND 23109 OF T~E CA~iFoRNia 9E~ICt,E <br />CODE AT C~.~TAiN PRYgA~E PAR~ING PACiLiTiRS AND TfLE <br />SIGNING FOR PAR~YN~ ~AC~S DE~IGNATkD FOR T~E <br />P.HYSiCALLY RANDICAPPED AT SAID FACiLITieS. <br /> <br /> WHEREAS by Ordinance No. 4587 adopted on September 5, <br />1978, Title i0 of the Rigerslde Municipal Code was amended by <br />adding thereto a new Section i0,44.i~7 relating to the enforce- <br />ment of sections 22350, 22507.8, ~3103 and 23109 of the <br />California Vehicle Code at certain private parking facilities <br />generally held open for Use of the Public for purposes of <br />vehicular parklng; and <br /> <br /> WHEREAS said Section 10.44.117 was adopted pursuant to <br />the provisions of Section 21107.8 of the California'.Vehicle <br />Code which then provided that the provisions of Sections 22350, <br />22507.8, 23103, and 23109 of the Vehicle Code shalt apply to <br />privately oWned and maintained offstreet parking facilities_. <br />only a~ter the city or County has by ordinance or resolution <br />found and declared said facility to be generally held open for <br />use of the public for purposes of vehicular parking; and <br /> <br /> WHEREAS the primary purpose for the adoption of <br />Ordinance No. 4587 was to permit the enforcement of Section <br />22507.8 of the Vehicle Code which prohibits the pa~klng of any <br />vehicle in a stall or spa~e designated for physically handicapped <br />persons unless the vehicle displays either one of the distin- <br />guishing license plates or placards issued pursuant to Section <br />22511.5 or to disabled veterans as specified in Section 9105 of <br />the Vehicle Code; and <br /> <br /> WHEREAS Chapter 522, Statutes of 1981, amended Sections <br />21107.8 and 22507.8 of the Vehicle Code to delete the require- <br />ment for a local ordinance or resolution prohibiting unauthorized <br /> <br /> <br />
