The City Council hereby finds <br />and determines that new private development in the City <br />of Riverside increases the amount of traffic utilizing <br />the City street system thereby requiring the installa- <br />tion of additional traffic signals and railroad signals <br />including crossing gates and associated work in order to <br />protect the public health, safety and welfare and that <br />such private new development should pay its fair share <br />of such improvements. The purpose of this chapter is to <br />provide for the payment of fees for each new nonresiden- <br />tial unit, residential dwelling unit and mobilehome <br />space; said fees to be placed in a specially designated <br />account to be utilized for the purchase and installation <br />of traffic signals and railroad signals including cross- <br />ing gates and other protective devices and all costs <br />associated with railroad crossing protection." <br /> <br />Section 2: Section 16.07.060 of the Riverside Municipal <br /> <br />Code is hereby amended to read as follows: <br /> <br /> "16.07,060 USE OF FUNDS. A special Traffic Signal <br />and Railroad Crossing Improvement Mitigation Fee Account <br />is hereby established and all fees collected pursuant to <br />this chapter shall be deposited therein. Such funds <br />shall be expended solely for the purchase and <br />installation of traffic signals and railroad signals <br />including crossing gates and other protective devices, <br />and all costs associated with railroad crossing <br />protection, including, but not limited to, planking, <br />sidewalks and curbs and gutters." <br /> <br />Section 3: The City Clerk shall certify to the adoption <br /> <br />of this ordinance and cause publication once in a newspaper of <br /> <br />CITY ATTORNEY <br />RIVERSIDE <br /> CALl FORNIA <br /> <br /> <br />
