6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br /> 11 <br /> <br /> 12 <br /> <br />13 <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br /> 20 <br /> <br />22 <br /> <br />23 <br /> <br />2~ <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />ORDINANCE NO. 5631 <br /> <br />AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br />AMENDING TITLE 8 OF THE RIVERSIDE MUNICIPAL CODE <br />RELATING TO ANIMALS BY AMENDING SUBSECTION (C) OF <br />SECTION 8.02,010 DEFINING "VICIOUS DOG" AND SECTION <br />8.04.070 IMPOSING CERTAIN REQUIREMENTS ON ANY PERSON <br />OWNING, OR HAVING CHARGE, CUSTODY OR CONTROL OF A <br />VICIOUS DOG, BY FURTHER AMENDING SECTION 8.02.010 <br />BY ADDING THERETO A NEW SUBSECTION (h) DEFINING <br />"ABUSED DOG", AND BY AMENDING CHAPTER 8.04 BY <br />ADDING THERETO A NEW SECTION 8.04,045 RELATING TO <br />THE DUTY TO RESTRAIN A DOG ON PROPERTY WHILE NOT <br />ON LEASH. <br /> <br />The City Council of the City of Riverside does ordain as <br /> <br />follows: <br /> <br />Section 1. Subsection (c) of Section 8.02.010 of the <br /> <br />Riverside Municipal Code is hereby amended to read as follows: <br /> <br /> "(c) 'Vicious dog' means any dog which constitutes <br />a physical threat to a human being or any other domestic <br />animal by virtue of a known propensity to endanger life <br />by an unprovoked assault or bite so as to cause serious <br />bodily harm. Any dog trained, primarily or in part, to <br />attack or fight shall constitute prima facie evidence <br />that the dog has a known propensity to endanger life. A <br />dog shall not be deemed vicious if it: (1) attacks, <br />bites or menaces anyone assaulting the owner of such <br />dog, a trespasser on the property of the owner, or any <br />person or other animal who has tormented or abused it; <br />(2) is otherwise acting in defense of an attack from a <br />person or other animal upon the owner or other person; <br />or (3) is protecting or defending its young or other <br />animal. A dog shall not be deemed vicious if it is an <br />official police dog or a 'protection dog' as defined by <br />Section 7521(f) of the Business and Professions Code if <br />registered as required by Section 7550.2 of said <br />Business and Professions Code." <br /> <br />Section 2.
