2 <br /> <br />3 <br /> <br />4 <br /> <br />6 <br /> <br />7 <br /> <br />8 <br /> <br />9 <br /> <br /> 20 <br /> <br /> 22 <br /> 23 <br /> 24 <br /> 25 <br /> 26 <br /> 27 <br /> 28 <br /> 29 <br /> 30 <br /> <br />RMC/lc 32 <br /> <br /> RESOLUTION NO, 14594 <br /> <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br /> RIVERSIDE, CALYFORNIA, AUTHORIZING THE DESTRUCTION <br /> OF POLICE DEPARTMENT flADIO AND TELEPHONE TAPE RECORD- <br /> INGS AFTER 100 DAYS, PROVIDED TI~AT SUCM RECORDINGS <br /> ARE NOT EVIDENCE IN ANY CLAIM OR PENDING LITIGATION. <br /> <br /> WHEREAS Government Code Sections 26202.6 and 34090.6 <br />provide that the head of a department of a city may destroy <br />recordings of radio and telephone cominunications after 100 days, <br />provided that the destruction is approved b~ the legislative body <br />and in writing by the city attorney, and further provided that <br />such recordings are not evidence in any claim or pending liti- <br />gation; and <br /> <br /> WHEREAS the City Attorney of the city of Riverside ha~ <br />given his written consent to the Chief of Police of the Riverside <br />Police Department to destroy recordings pursuant to Government <br />Code Sections 26202.6 and 34090.6; <br /> <br /> NOW, THEREFORE, BE iT RESOLVED by the City Council of <br />the City of Riverside that the Chief of Police is authorized to <br />destroy recordings of telephone and radio COMmunications main- <br />tained by the Riverside Police Department provided that such <br />recordinqs are not evidence in any claim filed or any pending <br />litigation. Recordings which are evidence in a claim or pending <br />litigation shall be retained until said claim or litigation is <br />resolved. <br /> <br /> ADOPTED by the City Council and signed by the Mayor and <br />attested by fhe City Clerk this 5th day of January, 1982. <br /> <br />Attest: <br /> <br /> <br />
