Distribution:
Mayor
City Council
City Ma ager,/
Legal

AUG 2 1 1997
August 20, 1997 ~

G. Harold Duffy
Sr. Administrative Assistant
Public Works Department
City of Riverside
3900 Main Street
Riverside, CA 92522

Dear Harold:

I am in receipt of your faxed letter in which you attempt to cover yourself with Mr. Beck.
We both know that you only called this week regarding recycling at City Hall. You and I have
had several conversations over the last two or three weeks and you have made no mention of a
lack of service of the Ability Counts barrels.

You spoke to Mr. LaValley of our office this week and voiced your concerns, and, as he
informed you, we have logged all pickups at City Hall and we have not missed a service day. If
you need more service days, simply request them. I'm sure, however, that this is simply your
attempt to invoke punitive action on NEWCO because you don't care for us fighting for our
rights to prevent you and/or the City from putting us out of business. I furthermore perceive this
as another step in your "tightening" your marriage to Burrtee. Quite frankly, I have been
expecting this threat for quite some time. Harold, you are getting quite predictable.

I am confident that you recall the conference call you instituted between the two of us
and a resident in which the lady told you, "You should do your homework and get the facts right
before misrepresenting the truth." It is in this context that I make the following request.

Because of your too convenient memory, I ask you to allow me to recall for you a bit of
history. A couple of months ago, we spoke on the issue of monetary compensation. During that
conversation, I informed you, as I had previously informed Quincy, that the materials were
being mixed rather than separated, so the value of the different papers was greatly reduced to
that of mixed paper. You stated, as did Quincy before, that you would rectify the situation and
get back to me when you had done so. That has obviously not happened as the materials of
greater value are still being mixed at this time. The ball remains in your court, Harold.
