Declarant is the Owner of the Property located at 6935 Arlington A venue, <br />Riverside, California, as more specifically described and depicted in Exhibit "A" attached hereto <br />and incorporated herein by reference. This Covenant is being imposed by Declarant upon the <br />Property. <br /> <br />1.02. In connection with Planning Case P07-1171 for a Conditional Use Permit for an <br />indoor rock climbing facility on the Property, the City of Riverside ("City"), in order to insure <br />adequate parking, has conditioned that a covenant be recorded against the Property limiting the <br />number of occupants. <br /> <br />1.03. Declarant, in satisfaction of that condition, desires to restrict the occupancy of the <br />Property and to put future owners on notice of the prohibition. <br /> <br />NOW THEREFORE, for the purposes of complying with the condition imposed in <br />Planning Case No.P07-1171, Declarant hereby covenants and agrees with the City that the <br />following restrictions shall apply to the Property: <br />
