<br />IMPARTIAL ANALYSIS BY CITY ATTORNEY <br />City of Riverside Measure F <br /> <br />(Keeping of Crowing Roosters (Male Chickens) in the Residential Agricultural <br />and the Residential Conservation Zones) <br /> <br />This Measure contains proposed amendments to Title 19 of the Riverside Municipal <br />Code (Zoning Code) with respect to uses permitted in the Residential Agricultural (RA) <br />and the Residential Conservation (RC) Zones. <br /> <br />Currently, the Zoning Code ~f the City of Riverside permits the keeping of up to 50 <br />poultry including crowing fowl on any lot for non-commercial purposes provided such <br />animals are housed, kept or penned at least 100 feet from any residence on an <br />adjoining lot in the RA and RC Zones. The Code defines "crowing fowl" as "any rooster, <br />peacock, goose, duck, guinea fowl or any other fowl which by their sound or cry <br />unreasonably disturb the peace and quiet of the neighborhood." <br /> <br />The proposed amendments, if approved by a majority of the voters, would reduce from <br />50 to 7, the number of crowing roosters that would be permitted on any lot in the RA <br />and RC Zones, provided that such roosters are housed from sunset to sunrise in an <br />acoustical structure so as to reduce noise emitted by such roosters and such structure <br />is at least 100 feet from any residential structure on an adjoining lot. <br /> <br />Further, the definition of "crowing rooster" would be added to the Zoning Code and <br />defined as "any male chicken two months of age or older." The definition of "acoustical <br />structure" would also be added to the Zoning Code and defined as "a structure that <br />would reduce noise emitted so as to be consistent with Title 7 - Noise Control of the <br />Municipal Code." <br /> <br />The effect of this Measure on the Zoning Code is limited to the keeping of crowing <br />roosters (male chickens) as set forth above and would not affect the current Zoning <br />Code with respect to the keeping of other poultry or crowing fowl. <br /> <br />If Measure F is approved, there would be no direct fiscal impact to the City of Riverside. <br /> <br />------- <br />This Impartial Analysis is hereby submitted to the Elections Official in conformance with <br />Section 9280 of the Elections Code of the State of California. <br /> <br />Dated: July ~ ,2007 <br /> <br /> <br />~,./ <br /> <br />RECEIVED <br />JUL 2 7 Z007 <br />r:t., Of O;y!::.r",:nj.c. <br />vH.
