<br />P05-IJ05 <br /> <br />RESOLUTION Nn 21202 <br /> <br />2 A RESOLUTION OF THE CITY COUNCiL OF THE CITY OF RIVERSrDE, <br />CA.LfFORNV\, MAKING ITS FD.'fDfNGS Al'-lU DETER1\HNA nONS IN THE <br />3 lY1ATTER OF RESOLUTION OF INTENTION NO, 21186; ,<\NT) MAKlL'fG as <br />ORDER v ACA TING A PORTION OF MCKINLE Y STREET BETWEEN <br />4 INDiANA AVENUE AND THE 91 FREEWAY, IN RIVERSIDE, CALIFORl'\l1A <br /> <br />5 WHEREAS, on June 20,2006 the City Council ofthe City of Riverside in Planning Case No. <br />6 P05- L305 adopted Resolution No. 21186 declaring its intention to order the vacation of a portion of <br />7 McKinley Street between Indiana A venue and the 91 freeway, within the City orRi verside, California, <br />8 and fixing the time and place of hearing all persons interested in the proposed vacation pursuant to the <br /> <br />9 provisions ofthe Public Streets, Highways and Service Easements Vacation Law, being Sections 8300 <br /> <br />10 et seq. of Part 3, Division 9 ofthe Streets and Highways Code of the State of California; and <br /> <br />II WHEREAS, notice of hearing before the City Council on said resolution of intention was <br /> <br />12 duly given as provided by said Public Streets, Highways, and Service Easements Vacation Law; and <br />l3 WHEREAS, said proposed vacation had been previously submitted to and considered by the <br />14 Planning Commission of the City of Riverside at a duly noticed public hearing held on February 9, <br /> <br />15 2006; and <br /> <br />16 WHEREAS, follOWing the close ofthe public hearing before the Planning Commission, the <br /> <br />t'7 Planning Commission determined that the proposed vacation would not have a significant effect on the <br /> <br />18 environment, recommended that the City Council should adopt a Mitigated Negative Declaration, and <br /> <br />19 recommended that Planning Case No. P05-1305 should be approved subject to aU staffconditions; and <br />20 WHEREAS, the recommendations ofthe Planning Commission were submitted to the City <br />21 Council for consideration together with the testimony, whether oral or in writing, presented at the public <br />22 hearing before said City CounciL; and <br /> <br />23 WHEREAS, the City CDWI.;;;J heard and found and (h,;t~rmined trDm all u f the; \( id,c::n,;t; <br /> <br />24 <br /> <br /> <br />,. . <br />.., <br /> <br /> <br />flx,xl <br /> <br /> <br />"j <br /> <br />I" i: ;--: \.~ ~)~ ':, r~ <br /> <br />.~5.
