ORDINANCE NO. 6437 <br /> <br />AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, RENEWING A <br />NON-EXCLUSIVE CABLE TELEVISION SYSTEM FRANCHISE WITH <br />CHARTER COMMUNICATIONS ENTERTAINMENT II, L.P., TO OPERATE, <br />MAINTAIN, CONSTRUCT AND RECONSTRUCT A CABLE TELEVISION <br />SYSTEM WITHIN THE CITY OF RIVERSIDE FOR A TEN YEAR TERM WITH <br />UP TO A FIVE YEAR EXTENSION. <br /> <br />1 <br /> <br />2 <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />6 The City Council of the City of Riverside, California, does ordain as follows: <br />7 Section 1: Unless it shall be apparent from the context that they shall have a different <br />8 meaning, the following words and phrases shall have the meaning herein specified: <br />9 (A) "Grantee" shall mean Charter Communications Entertainment II, L.P., a Delaware limited <br />10 partnership, doing business as Charter Communications. <br />11 (B) "Franchise Documents" shall mean and shall include all of the following, as amended from <br />12 time to time: <br />13 (1) Article XIII of the Charter of the City of Riverside; <br />14 (2) Chapter 5.56 of the Riverside Municipal Code; <br />15 (3) This Ordinance; and <br />16 (4) The Franchise Agreement between the City of Riverside and Grantee, attached hereto <br />17 as Exhibit "1 ". <br />18 Section 2: The City Council of the City of Riverside, California ("City") hereby renews <br />19 the nonexclusive cable television system franchise originally granted by Ordinance No. 3754 on <br />20 September 22, 1970, and thereafter transferred to Grantee under the authority of Resolution No. <br />21 18766 adopted on August 15, 1995. The franchise shall be for a term of ten (10) years with an <br />22 extension up to five (5) years upon timely completion of the upgrade of the cable system for a total <br />23 term not to exceed fifteen (15) years.
