6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />lO <br /> <br />ll <br /> <br />12 <br /> <br />15 <br /> <br />~6 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br /> 20 <br /> <br /> 21 <br /> <br /> 22 <br /> <br />2] <br /> <br />2~ <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />CITY ATTORNEY <br />RIVERSIDE <br />CALIFORNIA <br /> <br />ORDINANCE NO. 5913 <br /> <br />AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, <br />AMENDING TITLE 10 OF THE RIVERSIDE MUNICIPAL CODE <br />BY ADDING A NEW SECTION ENUMERATED AS 10.20.035 <br />RELATING TO USE OF PHOTO RADAR. <br /> <br />The City Council of the City of Riverside, California, <br /> <br />does ordain as follows: <br /> <br />Section 1: Title 10 of the Riverside Municipal Code is <br /> <br />hereby amended by adding a new Section 10.20,035 relating to the <br /> <br />use of photo radar, which section shall read as follows: <br /> <br />"10.20,035 USE OF PHOTO RADAR. <br /> <br /> (A) Authority: <br /> Officers of the City Police Department may use <br />a device known as a photo radar unit. A photo radar <br />unit detects, photographs, and records information on <br />every vehicle that passes a particular roadway location <br />while exceeding a certain speed limit. <br /> <br /> (B) Procedure: <br /> If any vehicle has been detected as having <br />violated the restrictions of California Vehicle Code <br />Sections 222348-22414, the license plate number which <br />appears on the photograph which is taken by the unit <br />will be used to trace the registered owner of the <br />vehicle through the Department of Motor Vehicles. The <br />owner will then be sent by regular first class mail <br />within 10 days from the date of the offense a citation <br />and fine/bail schedule. The rules and procedure of <br />traffic court will then apply. <br /> <br /> (c) Presumption: <br /> Proof of the identity of the person in whose <br />name the vehicle is registered pursuant to the <br />provisions under the Vehicle Code will be sufficient <br />evidence that the person was responsible for the <br />violation, unless probative contrary evidence exists and <br />the Judge or Commissioner is so persuaded. <br /> <br /> (D) Defenses: <br /> Nothing in this section shall limit the defenses <br />to or evidence otherwise probative and admissible <br />concerning the violation or responsibility. <br /> <br />(s) <br /> <br />Duty to Inform: <br />The registered owner of the vehicle, if found <br /> <br /> <br />
