CORRECTED <br /> <br /> 1 <br /> <br /> 2 <br /> <br /> 3 <br /> <br /> 4 <br /> <br /> 5 <br /> <br /> 6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br />10 <br /> <br />11 <br /> <br />12 <br /> <br />RESOLUTION NO. 17341 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF RIVERSIDE APPROVING AND AUTHORIZING <br />EXECUTION AND DELIVERY OF FUNDING, CONSTRUC- <br />TION AND ACQUISITION AGREEMENT RELATING TO <br />PUBLIC FACILITIES WITHIN AND FOR PROPOSED <br />COMMUNITY FACILITIES DISTRICT NO. 90-1 <br /> <br /> WHEREAS, the City Council ("the City Council") of the <br />City of Riverside (the "City") is considering the initiation of <br />proceedings pursuant to Chapter 2.5 (commencing with ~ 53311) of <br />Part 1 of Division 2 of Title 5 of the California Government <br />Code, the "Mello-Roos Community Facilities Act of 1982", for the <br />establishment of proposed Community Facilities District No. 90-1 <br />(the "District") for the financing of the design, construction <br /> <br />13 and acquisition <br /> <br />14 District; and <br /> <br />15 <br /> <br />16 <br /> <br />17 <br /> <br />of public facilities within and for the <br /> <br /> WHEREAS, pursuant to Section 53314.9 of the California <br />Government Code, at any time, either before or after the <br />formation of a community facilities district, the legislative <br /> <br />18 body conducting proceedings for the formation of such a district <br />19 may accept advances of funds from any source, including, but not <br />20 limited to, private persons or private entities and may provide, <br />21 by resolution, for the use of those funds for any authorized <br />22 purpose, including, but not limited to, paying any costs <br />23 incurred by the local agency in establishing the community <br />24 facilities district, and the legislative body may enter into an <br />25 agreement, by resolution, with the person or entity advancing <br />26 the funds to repay all or a portion of the funds advanced; and <br />27 WHEREAS, pursuant to Section 53313.5 of the California <br />28 Government Code, a community facilities district may finance the <br /> <br /> <br />
