CORRECTED 1 2 3 4 5 6 7 8 9 10 11 12 RESOLUTION NO. 17341 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RIVERSIDE APPROVING AND AUTHORIZING EXECUTION AND DELIVERY OF FUNDING, CONSTRUC- TION AND ACQUISITION AGREEMENT RELATING TO PUBLIC FACILITIES WITHIN AND FOR PROPOSED COMMUNITY FACILITIES DISTRICT NO. 90-1 WHEREAS, the City Council ("the City Council") of the City of Riverside (the "City") is considering the initiation of proceedings pursuant to Chapter 2.5 (commencing with ~ 53311) of Part 1 of Division 2 of Title 5 of the California Government Code, the "Mello-Roos Community Facilities Act of 1982", for the establishment of proposed Community Facilities District No. 90-1 (the "District") for the financing of the design, construction 13 and acquisition 14 District; and 15 16 17 of public facilities within and for the WHEREAS, pursuant to Section 53314.9 of the California Government Code, at any time, either before or after the formation of a community facilities district, the legislative 18 body conducting proceedings for the formation of such a district 19 may accept advances of funds from any source, including, but not 20 limited to, private persons or private entities and may provide, 21 by resolution, for the use of those funds for any authorized 22 purpose, including, but not limited to, paying any costs 23 incurred by the local agency in establishing the community 24 facilities district, and the legislative body may enter into an 25 agreement, by resolution, with the person or entity advancing 26 the funds to repay all or a portion of the funds advanced; and 27 WHEREAS, pursuant to Section 53313.5 of the California 28 Government Code, a community facilities district may finance the
