<br /> 1 RESOLUTION NO. 798 <br />I 2 A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF <br /> RIVERSIDE, CALIFORNIA, FINDING AND DETERMINING THE PUBLIC <br /> 3 INTEREST AND NECESSITY FOR ACQUIRING AND AUTHORIZING THE <br /> CONDEMNATION OF CERTAIN INTERESTS IN CERTAIN REAL <br /> 4 PROPERTY LOCATED WITHIN THE DOWNTOWN/AIRPORT <br /> INDUSTRIAL REDEVELOPMENT PROJECT AREA. <br /> 5 <br /> 6 WHEREAS, the Secretary for the Redevelopment Agency of the City of Riverside <br /> 7 ("Agency") duly noticed the Agency's intention to adopt a resolution of necessity pursuant to <br /> 8 California Code of Civil Procedure ~ 1245.235 to acquire certain interests in real property by <br /> 9 eminent domain for the purpose described as consolidation of ownership for redevelopment <br /> 10 purposes ("Project"); and <br /> 11 WHEREAS, a public hearing was held by the Agency on September 5, 2006, at the time <br /> 12 and place stated in the Notice of Intention to Adopt Resolution of Necessity, at which time the <br /> 13 Agency duly considered the matters to be heard; and <br />I 14 NOW, THEREFORE, BE IT FOUND, RESOLVED, DETERMINED, AND ORDERED <br /> 15 by the Redevelopment Agency of the City of Riverside, California, by a vote of not less than two- <br /> 16 thirds of its members, as follows: <br /> 17 1. The real property interests sought to be acquired are located within the <br /> 18 Downtown! Airport Industrial Redevelopment Project Area ("Project Area") in the city and county <br /> 19 of Riverside, state of California, and are legally described in the attached Exhibit 'A.' The interest <br /> 20 to be acquired herein is a leasehold estate. A parcel map depicting the general location and <br /> 21 dimensions of the interest to be acquired is attached hereto as Exhibit 'B.' Exhibits 'A' and 'B' <br /> 22 are incorporated herein by this reference ("Subject Property"). <br /> 23 2. The Agency is authorized to acquire the Subject Property by exercise of the right <br /> 24 of eminent domain pursuant to the California Redevelopment Law (Part 1 of Division 24, Health <br /> 25 & Safety Code), including without limitation Health & Safety Code ~ 33391(b), the Eminent <br />I 26 Domain Law commencing with California Code of Civil Procedure ~ 1235.010, Article I Section <br /> 27 19 of the Constitution of the State of California, and the United States Constitution. <br /> 28 <br />I <br />
