<br />I <br /> <br />I <br /> <br />I <br /> <br />1 <br /> <br />RESOLUTION NO. 785 <br /> <br />A RESOLUTION OF THE REDEVELOPMENT AGENCY FOR THE CITY OF <br />RIVERSIDE, CALIFORNIA, FINDING AND DETERMINING THE PUBLIC INTEREST <br />AND NECESSITY FOR ACQUIRING AND AUTHORIZING THE CONDEMNATION <br />OF CERTAIN INTERESTS IN CERTAIN REAL PROPERTY LOCATED WITHIN THE <br />MAGNOLIA CENTER REDEVELOPMENT PROJECT AREA <br /> <br />2 <br /> <br />3 <br />4 <br /> <br />5 WHEREAS, the Secretary for the Redevelopment Agency for the City of Riverside ("Agency") <br /> <br />6 duly noticed the Agency's intention to adopt a Resolution of Necessity pursuant to California Code of <br /> <br />7 Civil Procedure 9 1245.235 to acquire certain interests in real property by eminent domain for <br /> <br />8 assemblage and redevelopment purposes ("Project"); and <br />9 WHEREAS, a public hearing was held by the Agency on April 18, 2006, at the time and place <br />10 stated in the Notice of Intention to Adopt Resolution of Necessity, at which time the Agency duly <br /> <br />II considered the matters to be heard; and <br /> <br />12 NOW, THEREFORE, BE IT FOUND, RESOLVED, DETERMINED AND ORDERED by the <br /> <br />13 Redevelopment Agency for the City of Riverside, California, by a vote of not less than two-thirds of <br /> <br />14 its members, as follows: <br /> <br />15 I. The real property interests sought to be acquired are located within the Magnolia Center <br />16 Redevelopment Project Area ("Project Area") in the City and County of Riverside, State of Cali fomi a <br />17 and are legally described in the attached Exhibit "A." The interest to be acquired herein is a fee simple <br /> <br />18 absolute. A parcel map depicting the general location and dimensions ofthe interest to be acquired is <br /> <br />19 attached hereto as Exhibit "B." Exhibits "A" and "B" are incorporated herein by this reference ("Subject <br /> <br />20 Property"). <br /> <br />21 2. The Agency is authorized to acquire the Subject Property by exercise of the right of eminent <br /> <br /> <br />22 domain pursuant to the California Redevelopment Law (Part 1 of Division 24, Health & Saf. Code) <br /> <br /> <br />23 including without limitation, Health and Safety Code 9 33391(b); the Eminent Domain Law, <br /> <br /> <br />24 commencing with California Code of Civil Procedure 9 1235.010; Article I Section 19 of the <br /> <br /> <br />25 Constitution of the State of California; and the United States Constitution. <br /> <br /> <br />26 3. Facts in support of findings contained in staff's report to Agency dated April 18, 2006, are <br /> <br /> <br />27 hereby adopted and incorporated herein by this reference. <br />
