The Lord's Prayer was recited in unison by the assembly~ The Pledge of Allegiance was given ~o the ?lag~ The Min~tes cf the Meeting of December 22~ 1964~ were Motion approved as submitted~ Second All Ayes The City Council entered in~o further discussion on the request from Mr~ Ernest N~ Webb~ relating to the widening of Tyler Avenue and possible deed requirement relating to Zoning C~se E-135-634~ for Mro Clarence Pettenger~ The Public Works Direcvcr preset%ed a map of the area and recom- mended planned street development to solve the problem~ which plan was concurred in by Mr~ Webb; ~nereupon~ author- ization was given to install curb anc guzter at k3 feet from centerline and have a five foot area in back of the curb and gut%er for pedestrian travel~ making a right of way of g8 feet; waiver of vhe sidewalk requirement was granted; street light installation was required~ and the cost of moving ~he power poles~ if necessary~ to be borne by zhe applicant; and further~ an Encroachment Permit was granted for the por-~ Motion tion of the building ex~ending beyond the 48 fee~ with Secona execution of the Pe~nit suuhorized and directed, All Ayes The City Council entered into further discussion on the request fromM r~ Wade ~eeier for w~iver of ~ne 55 foot width requirement on Tyler Av~nme as i% relates tc the pro- posed service st~%icn deveiopmeut at the corner of Magnolia and Tyler Avenues~ Tr~e Public Works Director presented a map of ~he area and feeble, dod planned stree~ development within the proposed 55 feel of dedicated right of way to solve the problem~ which plan was concurrem in by represen- tatives from the 0il Com~pany developing bhis proper~y; whereupon~ authoriza~ion was given thmtthe curb mhd gutter be installed 43 feet from cemserline~ ~he 33 ~oot curb return be instalied~ the driveway ~pproaeh on ~gnoiia nearest Tyler Avenue be allowed to encroach 9 feet into ~he curb return~ the sidewalk to be 8 feet inssead of i2 feet~ and that an Encroachment Permit be ailowe~ for the ovefhsmg into the parkway on Tyler Avenue and the cost of relocabing the signal system at this ]ocatioD to be borne by the City and the deveioper~ ~nd further allowing an Encroachmepz Permit for luminalres and signs on Tyler Avenue~ and allow- lng the developer to move the island 3 feet to the southeast away from Tyler _gvenue a~d also to permit the building to Motion be moved ~ feet in a southeasterly dJrection~ also author- Second izing the execution of the Encroachment Permit ~ All Ayes Mr. James F, Davidson~ Jr~ appeared before the City Councml on behalf of the developer of Tract 2908~ requesting the appropriation of funds for an off-site sewer extension to serve this Tract~ Following a report from the Public Works Director that the sewer could be extended from the inwer- section of Chicmgo Avenue and Massachusetts Avenue to ~he Subdivision boundary a~ an es~in~ted cost of $4~500.00~ approval was given for City participation in the estimated Motion amcuuat of $4,500~00 from the Unappropriated Surplus in the Second Sewer Service Pund t~ard this projeet~ All Ayes 50-192
