10 <br /> <br /> 11 <br /> <br /> 12 <br /> <br /> 13 <br /> <br /> 14 <br /> <br /> 15 <br /> <br /> 16 <br /> <br /> 17 <br /> <br /> 18 <br /> <br /> 19 <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />1 <br /> <br />2 <br /> <br />3 <br /> <br />4 <br /> <br />5 <br /> <br />6 <br /> <br />7 <br /> <br />8 <br /> <br />9 <br /> <br /> RESOLUTION NO. 763 <br /> <br /> A RESOLUTION OF THE REDEVELOPMENT AGENCY FOR THE CITY OF <br /> RIVERSIDE, CALIFORNIA, FINDING AND DETERMINING THE PUBLIC <br /> INTEREST AND NECESSITY FOR ACQUIRING AND AUTHORIZING THE <br /> CONDEMNATION OF CERTAIN INTERESTS IN CERTAIN REAL PROPERTY <br /> LOCATED WITHIN THE ARLINGTON REDEVELOPMENT PROJECT AREA <br /> <br /> WHEREAS, the Agency Secretary for the Redevelopment Agency for the City of Riverside <br />("Agency") duly noticed the Agency's intention to adopt a Resolution o fNecessity pursuant to California <br />Code of Civil Procedure § 1245.235 for the purpose of acquiring certain interests in real property by <br />eminent domain in the Arlington Redevelopment Project Area ("Project Area") for consolidation and <br />redevelopment of California Square ("Project"); and <br /> <br /> WHEREAS, a public hearing was held by the Agency on June 14, 2005, at the time and place <br />stated in the Notice of Intention to Adopt Resolution of Necessity, at which time the Agency duly <br />considered the matters to be heard; ~md <br /> <br /> NOW, THEREFORE, BE IT FOUND, RESOLVED, DETERMINED AND ORDERED by the <br />Redevelopment Agency for the City of Riverside, California, by a vote of not less than two-thirds of its <br />members, as follows: <br /> <br /> 1. The real property interests sought to be acquired are located within the Arlington <br />Redevelopment Project Area in the City and County of Riverside, State of California and are legally <br />described in the attached Exhibit "A". The interest to be acquired herein is fee simple absolute. A <br />>arcel map depicting the general location and dimensions of the interest to be acquired is attached hereto <br />ts Exhibit "B". Exhibits "A" and "B" are incorporated herein by this reference ("Subject Property"). <br />The Subject Property is improved with an abandoned, boarded up and obsolete service station. <br /> <br /> 2. The Agency is authorized to acquire the Subject Property by exercise ofthe right of eminent <br />domain pursuant to the California Redevelopment Law (Part I of Division 24, Health and Safety Code) <br />including without limitation, Health and Safety Code § 33391(b); The Eminent Domain Law, <br />commencing with California Code of Civil Procedure § 1235.010; Article I § 19 of the Constitution of <br />the State of California; and the United States Constitution. <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(951) 826-5567 <br /> <br /> <br />
