NICOL City Clerk DATE: Januaw 31, 2005 KEN GUTIERREZ Planning Director REQUESTFORFUTURE AGENDAITEM-LAND USE NOTIFICATIONR On January 4, 2005, Councilmember Hart requested a report to the City Council regarding notification of land use matters to surrounding property owners. She was receiving calls from constituents that they were not notified of nearby projects. At a meeting with Councilmember Hart on Thursday, January 20, 2005, we discussed that the Land Use Committee had recently deliberated the appropriateness of the notification which in most cases is a 300' radius of the project site. Subsequently, the City Council accepted the Land Use Committee's unanimous recommendation that the 300' radius be retained. It has been found that at times those who claim they were not notified had indeed received a notice but did not recognize it as such and the notice was discarded as unimportant mail. In response, the Planning Director and City Clerk are working together to revise the City Council public hearing notice to a simpler, more friendly design which will replace formal language with a "flier" format including a map which would alert the property owner that the message affects their neighborhood. We also plan to add a message to the outside of the public hearing notice envelope to identify the importance of its contents. Samples of the new hearing notice format and envelope will be distributed when finalized. Councilmember Hart's concern in this regard was adequately addressed by the planned changes. A full report will not be forwarded to the City Council at this time. Please let us know if there are outstanding issues not addressed by the above.
