CITY COUNCIL <br /> AND <br />REDEVELOPMENT AGENCY <br />MIINUTES <br /> <br /> TUESDAY, NOVEMBER 23, 2004, 1:30 p.m. <br />ART PICK COUNCIL CHAMBER, CITY HALL, 3900 MAIN STREET <br /> CITY CLERK'S OFFICE - 951-826-5557 <br /> WARDS <br /> <br />COUNCIL/AGENCY <br />MEMBERS <br /> <br />Roll Call: <br /> <br />CITY COUNCIL <br /> <br />In the absence of Mayor Loveridge, Councilrnember Adkison called the <br />meeting to order at 1:35 p.m. <br /> <br />CLOSED SESSIONS <br /> <br />ORAL COMMUNICATIONS FROM THE AUDIEN,CE <br />Mary Shelton spoke regarding Officer Tina Banfill Gould and the Charter <br />amendments. <br /> <br />Mayor Loveridge and Councilmember Gage entered the meeting at this time. <br /> <br />The City Council recessed to the City Council Board Room for closed <br />sessions pursuant to Government Code (1) §54956.9 to confer with and/or <br />receive advice from legal counsel concernin9 one case of anticipated <br />litigation; (2) §54957.6 to review the City Council's position and instruct <br />designated representatives regarding salaries, salary schedules, or <br />compensation paid in the form of fringe benefits for Fire Management Unit, <br />Riverside City Firefighter's Association, Riverside Police Officers Association <br />(Police and Police Supervisory Units), Service Employees International <br />Union, Service Employees International Union-Refuse, and International <br />Brotherhood of Electrical Workers; and (3) §54957.6 to review the City <br />Council's position and instruct designated representatives regarding salaries, <br />salary schedules, or compensation paid in the form of fringe benefits for all <br />Executive Management, Management, and Confidential employees, as <br />defined by PERS. <br /> <br />CLOSED SESSION ANNOUNCEMENT <br />City Attorney Priamos announced there were no reportable actions taken on <br />the closed sessions regarding §54957.6. City Attorney Priamos announced <br />the City Council having met in closed sessiolq regarding §54956.9 has <br />authorized the City Attorney to make a demand to cure the deficiencies of <br />Officer Gould's action before the Community Police Review Commission <br />(CPRC) on October 27, 2004. Officer Gould is to appear before the CPRC, <br />to be sworn as a witness, answer the appropriate foundational questions, as <br />well as questions regarding the incident in question, and be given an <br />opportunity to properly assert her Fifth Amendment right consistent with the <br />law. If the demand is refused, the City Council has further authorized by <br />unanimous vote to initiate contempt proceedings against Officer Gould in the <br />Riverside County Superior Court.
