1 RESOLUTION NO. 18177 <br />2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br /> OF RIVERSIDE, CALIFORNIA, ESTABLISHING PUBLIC <br />3 LIABILITY SETTLEMENT AUTHORITY LEVELS FOR <br /> DESIGNATED OFFICERS AND EMPLOYEES. <br />5 WHEREAS, Section 935.4 of the Government Code specifies <br />6 that a local public entity by ordinance or resolution may <br />? authorize an employee of the local public entity to allow, <br />8 compromise, or settle a claim against the local public entity in <br />9 an amount not to exceed Fifty Thousand Dollars (~50,000.00); and <br />10 WHEREAS, The City Council of the City of Riverside finds <br />11 that various local public entities have been surveyed and <br />12 authority to allow, compromise, or settle such claims differs as <br />13 and between the jurisdictions; and <br />14 WHEREAS, current delegated authority is limited to Ten <br />15 Thousand Dollars (~10,000.00) with the first level of authority <br />16 of Five Thousand Dollars (~5,000.00) delegated to the City's <br />17 Risk Manager and the second level of authority of an additional <br />18 Five Thousand Dollars ($5,000.00) is delegated to the City <br />19 Attorney; and <br />20 WHEREAS, there is an increasing number of claims to be <br />21 allowed, compromised, or settled which exceed the current <br />22 delegated authority but which do not exceed the sum of <br />g] Twenty-Five Thousand Dollars ($25,000.00); and <br />Zq WHEREAS, it has been proposed that the current <br />25 authorization to allow, compromise, or settle claims be amended <br />26 to increase the authority of the City Attorney and provide for <br />2? the City Manager to have said authority up to and including his <br />ATTORNEY <br />RIVERSIDE <br />FORNIA <br /> <br /> <br />
