l1i CITY OF RIVERSIDE CITY COUNCIL Minutes of: Time of Meeting: Place of Meeting: Date of Meeting: Regular Meeting of the City Council 3p.m. Art Pick Council Chamber, City Hall November 2, 2004 Roll Call: PUBLIC HEARINGSIPLANNING REFERRALS AND APPEALS CASE P03-1340 - VACATION - THIRTEENTH BETWEEN LIME AND MULBERRY - CONTINUED Hearing was called on the proposal of Doug Shackelton, on behalf of Sl. Francis de Sales Catholic Church to vacate a portion of Thirteenth Street between Lime and Mulberry Streets and a portion of the alley south of Thirteenth Street to accommodate a future church parking lot expansion. Following discussion, the City Council continued the public hearing to 3 p.m. on December 7,2004. Council member Adkison disqualified himself from participating in the following matter and left the dais as his firm Adkan Engineering has an unpaid monetary judgment against Dale Cook. CASE P03-1408 - TRACT MAP 32009 - APPEAL - ARLINGTON BETWEEN ROYALE AND SUNSET RANCH Further hearing was called on the appeal of Len Nunney on behalf of the Friends of Riverside's Hills and Roger D. Chaussee and H. Dale Cook of the decision of the Planning Commission in approving Tract Map 32009 by Dale Cook and Roger Chaussee to subdivide approximately 13.9 vacant acres into ten single-family residential lots situated on the southerly side of Arlington Avenue between Royale Place and Sunset Ranch Drive in Zones R-1-130 and RC. Two people spoke regarding the matter. One letter was presented and considered. Following discussion, the public hearing was officially closed. The City Council (1) accepted the withdrawal of the applicant's appeal; (2) upheld the decision of the Planning Commission in approving Case P03-1408 (Tract Map 32009) for nine lots subject to conditions thereby denying the appeal of Len Nunney on behalf of the Friends of Riverside's Hills; (3) adopted the staff report and environmental assessment as findings: (4) upheld the Planning Commission's determination that the project would not have a significant effect on the environment and concurred in the adoption of a Mitigated Negative Declaration; and (5) found that the project could have the potential for adverse effect on wildlife resources and the applicant is responsible for payment of Fish and Game fees at the time the Notice of Determination is filed with the County. CASE P04-0804 - PLANNED RESIDENTIAL DEVELOPMENT - APPEAL WITHDRAWN - ARLINGTON BETWEEN ROYALE AND SUNSET RANCH Further hearing was called on the appeal of Roger D. Chaussee and H.
