<br />l1i <br /> <br />CITY OF RIVERSIDE <br />CITY COUNCIL <br /> <br />Minutes of: <br />Time of Meeting: <br />Place of Meeting: <br />Date of Meeting: <br /> <br />Regular Meeting of the City Council <br />3p.m. <br />Art Pick Council Chamber, City Hall <br />November 2, 2004 <br /> <br />Roll Call: <br /> <br />PUBLIC HEARINGSIPLANNING REFERRALS AND APPEALS <br /> <br />CASE P03-1340 - VACATION - THIRTEENTH BETWEEN LIME AND <br />MULBERRY - CONTINUED <br />Hearing was called on the proposal of Doug Shackelton, on behalf of Sl. <br />Francis de Sales Catholic Church to vacate a portion of Thirteenth Street <br />between Lime and Mulberry Streets and a portion of the alley south of <br />Thirteenth Street to accommodate a future church parking lot expansion. <br />Following discussion, the City Council continued the public hearing to 3 p.m. <br />on December 7,2004. <br /> <br />Council member Adkison disqualified himself from participating in the <br />following matter and left the dais as his firm Adkan Engineering has an <br />unpaid monetary judgment against Dale Cook. <br /> <br />CASE P03-1408 - TRACT MAP 32009 - APPEAL - ARLINGTON BETWEEN <br />ROYALE AND SUNSET RANCH <br />Further hearing was called on the appeal of Len Nunney on behalf of the <br />Friends of Riverside's Hills and Roger D. Chaussee and H. Dale Cook of the <br />decision of the Planning Commission in approving Tract Map 32009 by Dale <br />Cook and Roger Chaussee to subdivide approximately 13.9 vacant acres into <br />ten single-family residential lots situated on the southerly side of Arlington <br />Avenue between Royale Place and Sunset Ranch Drive in Zones R-1-130 <br />and RC. Two people spoke regarding the matter. One letter was presented <br />and considered. Following discussion, the public hearing was officially <br />closed. The City Council (1) accepted the withdrawal of the applicant's <br />appeal; (2) upheld the decision of the Planning Commission in approving <br />Case P03-1408 (Tract Map 32009) for nine lots subject to conditions thereby <br />denying the appeal of Len Nunney on behalf of the Friends of Riverside's <br />Hills; (3) adopted the staff report and environmental assessment as findings: <br />(4) upheld the Planning Commission's determination that the project would <br />not have a significant effect on the environment and concurred in the <br />adoption of a Mitigated Negative Declaration; and (5) found that the project <br />could have the potential for adverse effect on wildlife resources and the <br />applicant is responsible for payment of Fish and Game fees at the time the <br />Notice of Determination is filed with the County. <br /> <br />CASE P04-0804 - PLANNED RESIDENTIAL DEVELOPMENT - APPEAL <br />WITHDRAWN - ARLINGTON BETWEEN ROYALE AND SUNSET RANCH <br />Further hearing was called on the appeal of Roger D. Chaussee and H.
