KUItN AND ERNA M. KUHN, husband <br /> and wife as community property ("Declarants") with reference to the following facts: <br /> <br /> A. Declarants are the fee owner of that certain real property (the "Property") <br /> located in the City of Riverside, Count)' of Riverside, State of California, described as follows: <br /> <br /> The Northerly 150 feet of the Easterly one-half of the Easterly one-half of Lot 1 in <br /> Block 28 of the Riverside Land and Irrigating Company, as shown by Map on file <br /> in Book 1 Page 70 of Maps, Records of San Bernardino County, California <br /> <br /> B. The Property consists of approximately 0.56 vacant acres at 3396 Harrison <br /> Street, situated on the southwest corner of Indiana Avenue and Harrison Street. An application has <br /> been filed with the City of Riverside ("City") as Case No. 04-0174 to rezone the property from its <br /> current zoning of R- 1-65 Single Family Residential to a combination of MP Manufacturing Park and <br />! ~[ M-2 General Industrial, in repetition of an established pattern of the adjacent property to the west. <br /> C. As a condition to the approval by the City in Case No. 04-0174, Declarants <br /> are required to prepare and record a covenant and agreement to limit the list of permitted uses for <br /> future development on the Property to only those permitted by the C-2 Restricted Commercial and <br /> MP Manufacturing Park Zones. <br /> <br /> NOW, THEREFORE, for the purpose of complying with the conditions imposed by <br />the City for the approval of the Property, Declarants hereby covenant and agree that the Property <br />is, and shall hereafter be held, transferred, sold, conveyed, hypothecated, encumbered, leased, <br />rented, improved, used and occupied subject to the following declarations, limitations, covenants, <br />conditions and restrictions: <br /> <br /> <br />
