1 <br /> <br />2 <br /> <br />3 <br /> <br />4 <br /> <br /> 5 <br /> <br /> 6 <br /> <br /> 7 <br /> <br /> 8 <br /> <br /> 9 <br /> <br /> 10 <br /> <br /> 11 <br /> <br />12 <br /> <br />13 <br /> <br />14 <br /> <br /> 15 <br /> <br />16 <br /> <br />17 <br /> <br />18 <br /> <br />19 <br /> <br />20 <br /> <br />21 <br /> <br />22 <br /> <br />23 <br /> <br />24 <br /> <br />25 <br /> <br />26 <br /> <br />27 <br /> <br />September 28, 2004 <br /> <br />Item: 26 <br /> <br />ORDINANCE NO. <br /> <br />AN ORDINANCE OF THE CITY OF RIVERSIDE, CALIFORNIA, AMENDING <br />TITLE 19 TO AMEND AND ESTABLISH DEVELOPMENT AND LOCATIONAL <br />STANDARDS FOR SMAIJ~ AND LARGE CHILD DAY CARE HOMES IN <br />RESIDENTIAL ZONES AND DAY CARE CENTERS IN NON-RESIDENTIAL <br />ZONES PURSUANT TO CALIFORNIA HEALTH AND SAFETY CODE. <br /> <br />The City Council of the City of Riverside, California, does ordain as follows: <br /> <br />Section 1: Chapter 19.04 "Definitions" of the Riverside Municipal Code is amended to <br /> <br />include the following definitions as follows: <br /> <br />19.04.111 Day Care Center. <br /> <br />"Day Care Center" means a child day care facility other than a family day care home, <br />including infant centers, preschools, extended day care facilities and school-age child care <br />centers (see California Health and Code Section 1596.76). <br /> <br />19.04.112 Day Care Home - Family. <br /> <br />"Day Care Home - Family" means a home that regularly provides care, protection and <br />supervision for fourteen (14) or fewer children, in the provider's own home, for periods of <br />less than 24 hours per day, while parents or guardians are away, and is either a large family <br />day care home or a small family day care home (see California Health and Safety Code <br />Section 1596.78 a). <br /> <br />19.04.113 Day Care Home - Large Family. <br /> <br />"Day Care Home - Large Family" means a home that provides family day care for seven (7) <br />to twelve (12) children, inclusive, including children under the age of ten (10) years who <br />reside at the home and can go up to fourteen (14) children if all of the following conditions <br />are met: <br /> <br />(1) At least one (1) child is enrolled in and attending kindergarten or elementary school and <br />a second child is at least six (6) years of age. <br /> <br />(2) No more than three (3) infants are cared for during any time when more than twelve (12) <br />children are being cared for. <br /> <br />(3) The licensee notifies a parent that the facility is caring for two additional school-age <br />children and that there may be up to thirteen (13) or fourteen (14) children in the home at one <br />time. <br /> <br />(4) The licensee obtains the written consent of the property owner when the family day care <br />home is operated on property that is leased or rented (see California Health and Safety Code <br />Section 1596.78 b and Section 1597.465). <br /> <br />City Attorney's Office <br />3900 Main Street <br />Riverside, CA 92522 <br />(951) 826-5567 <br /> <br />26-1 <br /> <br /> <br />
