WATER I ENERGY I LIFE <br />PUBLIC UTILITIES <br />RIVERSIDE PUBLIC UTILITIES <br />Board Memorandum <br />BOARD OF PUBLIC UTILITIES <br />DATE: DECEMBER 11, 2023 <br />SUBJECT: FIND MERRIE (MARY) SCOTT DBA SCOTT TRACTOR IN DEFAULT OF THE <br />AGREEMENT FOR LANDSCAPE MAINTENANCE SERVICES FOR WEED <br />ABATEMENT AND TRASH REMOVAL SERVICE — RFB NO. 7911 <br />ISSUE: <br />Consider finding Merrie (Mary) Scott dba Scott Tractor in default of the Agreement for Landscape <br />Maintenance Service for Weed Abatement and Trash Removal Service — RFB No. 7911 <br />RECOMMENDATIONS: <br />That the Board of Public Utilities: <br />1. Find Merrie (Mary) Scott dba Scott Tractor in default of the Agreement for Landscape <br />Maintenance Service for Weed Abatement and Trash Removal Service — RFB No. 7911, <br />as required by the Agreement; <br />2. Authorize the City Manager, or designee, to terminate Merrie (Mary) Scott dba Scott <br />Tractor's right to perform under the Agreement by issuing a written notice of termination <br />for default to Scott Tractor and its Surety, The Ohio Casualty Insurance Company; and <br />3. Authorize City Manager, or designee, to execute any documents necessary to carry out <br />the Agreement termination and effectuate the completion of the work, including documents <br />and agreements needed to carry out the Surety's obligations under the Agreement and <br />performance bond. <br />BACKGROUND: <br />On June 27, 2022, the Riverside Board of Public Utilities (Board) awarded a three-year Agreement <br />for weed abatement and trash removal to Merrie Scott dba Scott Tractor (Scott Tractor) in the <br />amount of $818,220 ($272,740 annually). This contract supports ongoing property maintenance <br />work to comply with weed and fire abatement notices and trash removal for facilities and <br />properties owned by Riverside Public Utilities (RPU). <br />The Agreement with Scott Tractor was executed on July 13, 2022, expiring June 30, 2025. On <br />June 27, 2023, Scott Tractor notified the City of Riverside (City) that they were no longer able to <br />perform the full scope of work under the Agreement due to the owner and operator experiencing <br />severe health complications that arose from the COVID-19 pandemic. <br />
