RESOLUTION NO. 741 RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF RIVERSDE ADOPT1NG RULES GOVERNING PARTICIPATION AND PREFERENCES BY OWNERS, OPERATORS OF BUSINESSES AND TENANTS, AND RULES AND REGULATIONS FOR IMPLEMENTATION OF THE CAL~ORNIA RELOCATION ASSISTANCE LAW AND PROPERTY ACQUISITION FOR THE LA SIERRMARLANZA REDEVELOPMENT PROJECT WHEREAS, the Redevelopment Agency has initiated proceedings to adopt the proposed La Sierra/Arlanza Redevelopment Project (the "Project"); and WHEREAS, the Agency, within a reasonable period of time before the approval of the Redevelopment Plan for the Project, is required to adopt Rules Governing Participation and Preferences by Owners, Operators of Businesses and Tenants (the "Owner Participation Rules"), pursuant to Sections 33339, 33339.5 and 33445 of the California Health and Safety Code (the "CRL"); and WHEREAS, CRL Section 33411 requires that the Agency prepare a feasible method or plan for relocation of families or persons or non-profit local community institutions to be temporarily or permanently displaced from within the project area, irrespective of whether any displacement of residents, businesses or others is anticipated; and WHEREAS, Section 7260 et seq. of the California Government Code requires a public entity to provide relocation advisory assistance to any person, business, or farm operation displaced because of the acquisition of real property for public use; and WHEREAS, City-wide Relocation Rules and Regulations were adopted on September 15, 1998, and will be adopted by reference for the Project. WHEREAS, City-wide Owner Participation Rules were adopted on February 3, 2004, and will be adopted by reference for the Project. NOW, THEREFORE, BE IT RESOLVED by the Redevelopment Agency of the City of Riverside, California, as follows: Section 1: The document entitled "Rules Governing Participation and Preferences by Owners, Operators of Businesses and Tenants," which was previously approved by the Agency on February 3, 2004, is hereby adopted as the "Owner Participation Rules" for the proposed La SierraJArlanza Redevelopment Project.
